Hello and welcome. I have some concerns for you right now when it comes to the house and who keeps it.

1) why’d you move it? Was their abuse and or constant fighting? Fear for your safety or was she concerned about her own safety?

2) how long have you been married for?

So normally one of our top three most important rules is not to move out of the residence. Most of us have lived that life and know it’s a tough thing to accept.

When you move out you 1) often times give up being able to see your kids 50-50 or better and 2) give up the inside of keeping property like your home once the divorce is finalized. I know you probably don’t want to kick a pregnant woman out but it’s either that, or living together, or losing out on a lot of your earned stuff and rights.

If I was you I’d move back in as soon as possible. I’d hate you to lose the home you bought and have been paying for on a technicality.

I do not know Florida law but as a general matter there’s an important distinction between pre-marital and marital assets. If the house is considered pre-marital it may not be subject to equitable distribution. Even if it is marital, if you contributed significant amounts pre-marital you may be entitled to a disproportionate share of the distribution (for example, 70/30). This came up in my divorce. Just want to arm you with questions for your lawyer bc mine may not have been sensitized to the economics if I didn’t raise the issue. Good luck!

My only advice is to beg borrow or steal to get a lawyer who will fight for you and not phone it in.

Then, do whatever your lawyer says to do. No more. No less.

Get together ALL of your financials: debts, paystubs from you and her, assets you own, etc.

Get proof of infidelity to control the narrative and it will make a difference in the financials if she spent money on the guy.

FYI: adultery is illegal in Florida. Like it's against the law. Just sayin.

Get a paternity test done as soon as possible. That baby might not be yours, or perhaps you already know it's not yours?

U would have to give her half the equity earned during the marriage from your house regardless if u are only on the deed or not
