That's always confused me, too. If he can't consent, then it is clearly rape. If he isn't too drunk for it to be legal, it's cheating. Same for women. It's a grey area.

This is a situation where both can be true. Just like with a woman, he has a degree of responsibility for the situation but that doesn't mean he could have consented. So if a married guy gets drunk with his single female co-worker and she has sex with him while he can't move, push her off, consent...then he was raped but also put himself in a situation where he was okay with cheating.

The man will know. If it was building up to it flirting etc throughout the evening then it's consensual. If he made it clear from the beginning it won't happen and later is drunk and it does happen and he feels he did not consent or was not in a state that he could give consent then yes that's rape.

You will know when it happens to you.

Society makes men believe they cannot be raped because they are bigger, the reality is drugs and alcohol can put you into a state that allows people to manipulate and take advantage of you. Call it out when it happens.

Also terminology; this would be classed as sexual assault if it was a woman but if it was penetrating sex with a man it is rape

Both terms can carry the same sentencing one is not worse than the other

I think the meaning of rape is being abused a bit. Forceful sex with another person. Literally having someone in a wrestling hold trying to get away from you while you penetrate them. Or a person being completely noodle limp, passed out is rape. Anything else is just regret. As far as cheating goes, it's more than just the sex part. Being in a place or situation where sex can happen is a big part of it. As a mature man I have never come close to accidentally getting laid. There has to be some intention there at some point to even be in a close situation like that.
