If Mary is convinced that Jeff raped her, and Jeff is adamant that he didn't, and there is no proof that he did rape her, but also no proof that he didn't, Mary could still get sued for millions, even though she genuinely believes he did rape her, but because there's no proof for them to hang their hat on, she not only loses the case, but has to pay millions?

I get it, "innocent until proven guilty" (which I'm willing to bet a lot of people wouldn't afford this to Men of Color, nevertheless) but isn't this a slippery slope when it comes to freedom of speech?
