Laws vary by state but a QCD is typically pointless until the divorce is finalized. The spouse would still maintain a marital interest in the property as long as you are legally married.

If the mortgage is under both names, she will need to refinance it under her name.

In my state, a QCD may be executed prior to divorce finalization. Probably a good idea to ask your lender or your title company.

The easiest thing for the Court to do is to require the house be sold and the equity split. That's not such a bad option for you. If she doesn't want that to happen, she needs to make a financial offer acceptable to you. If she makes an offer in mediation that's contingent on her getting a new mortgage that she's not really likely to get, you'll be going around and around a long time.

Talked to my finance guy. He suggested having her refinance as sole and seperate. This will create a new loan with only her name. I would be required to sign off in it. The advantage being it will be a new loan. I will get paperwork stating that the old loan was paid in full. According to him, in my state, the quit claim deed would just take my name off of deed not loan and because of that it would be handled in court S community property. I think thats my best option because then the court an insure I get my equity
