Chances are she will turn on you. I never believed it could happen to me until it did.

Be aware, she can always call the cops and get a 209A restraining order even if there is no reason. At least in MA, all they have to do is say they feel an objectively reasonable fear and imminence of danger. Doesn’t even need to be proven. My ex did this and got me out of the house without warning. No separation, nothing. Hopefully you’re dealing with a somewhat sane individual. Hang in there. It does get better but it takes a long time. 4 years later and I’m still dealing with BS and heartache for my kids.

I’m from KY but I also moved out. Stayed with my brother and have a lease I’m getting ready to sign. My advise, never leave the home I wish I hadn’t. She may want it but you’re entitled to split of any equity and once you leave it sets a precedent about returning unless you’re ok with just walking away. My situation may be different but I’m paying the entire mortgage and it’s in my name only and my STBEW is camped out and not cleaning it. She broke several things since I left (window, garage door etc, dishwasher). Repairs are to the point with my cash flow that I’m considering as is sale or seeing if I can get her evicted as she hasn’t cleaned it in over 4 months, except for occasional living room and kitchen. The only thing keeping me from pursuing is my 3 kids. But I’ll have an apartment within a couple of weeks and then it’s own. My kids can stay with me.

My wife and I haven’t started the divorce process. She is moving out middle August and I will have full custody of our two boys during the school year, with her have unlimited visiting rights. We will alternate weekends. Summer, she will have them full time, I will have unlimited visitation along with every weekend.

Since will haven’t sign parenting contact. We are doing this in trust between each other. You know your partner, if you feel that she could cross you, don’t, if not, keep your plan.

Are you on the mortgage?

Who will pay the mortgage while she lives there?

Has your agreement been turned into a court order?

I did the same, gave my wife the house in lieu of spousal support. When she sells she gets $600-$700K, she doesn't get any spousal ... but walks away with all the equity .. so it is kind dump, but the law is unfair, so for it makes sense, I am the higher earner, I can afford to go buy another place and start over.

How much is your mortgage, how much equity do you have in the house, you might want to strike a deal if you giving her the house and there is a lot of equity.
