They might win. Title IX is broad. It applies to private colleges too. If the school sponsors or funds the fraternities in any way they could easily be sucked in to the no-gender-discrimination-against-women rules. I wouldn’t bet either way on a case like this.

Let's be honest, sexual assault and groping will be happening at these frats. I was in mixed accommodation when I started uni, and it happened there too, surely it would only get worse when mixing in the stereotypical fratbro culture. It is a problem, and we should address it, is this the to do so? Maybe not, perhaps lowering the legal drinking age to the 18 would help. Then frathouses wouldn't be able to dominate the social scene during those first few years as much as they do. I can only offer anecdotal evidence, but there was one house on my campus which leaned heavier into the "lad" culture, and women just stopped going to their house parties, even the women who lived there. Why would you stick around when you can go basically anywhere else, and have just as good an evening.
