I consider myself mra but can the men's rights sub stop pretending Weinstein is innocent. This is getting ridiculous. This is trump supporter level dissonance. Not every guy accused of assault and rape is being falsely accused. The evidence is against Weinstein. You want to say you are going to keep out of it until a conviction that's fine. Don't look for some ridiculous fringe proof that he is innocent. Thats non sense. Let the courts settle this and focus on real issues like actual false accusations.

I've addressed that issue in other posts, he didn't admit to none consentual groping, it could have just been a misunderstanding he was trying to explain to her. Lots of women throw themselves at Weinstein, made in the previous context he thought she would be open to his advances, and she wasn't, perhaps presumptive on his part, but not sexual assault.

We are not handing out criminal penalties.
We are not bound by the court rules on admissable evidence.

What I do care about is due process.

I highly doubt (and legal articles have been written to this effect) that Weinstein could be convicted of raped on any of the allegations so far.

There are no alleged instances of underage sex (like Kevin Spacey) or non-mutual inebriation. These all seem to be cases of Weinstein asking for a quid pro quo: sex for vertical career movement. Many of the instances end in him being denied sex.

So, it is disgusting and weird but not legally sexual assault.

Because she was acting weird and hysterical when he only wanted to talk, which can be very scary, I mean he was doing everything he could think of to calm her down and reassure her.

I think he misijterrupted a signal, made a pass at her, she freaked out, he tried to talk it out, she got increasingly hysterical, then he freaked out when she wouldn't talk about it in private (he seems like someone who would HATE public humiliation).

Also I think some here have it out for Weinstein because he was a feminist and a Hillary supporters to boot.

All big trials like this start with accusations and then evidence will come out as the trial begins. That may be a lack of evidence, evidence to the contrary, or evidence that puts Harvey in jail. Sometimes witnesses are the only available evidence. We can't throw out every case ever because of a lack of hard evidence. That would allow evil people to walk free. Witness accounts are heavily verified and told again and again to check for errors. We can't simply get rid of the rights of victims so no innocent men go to jail. The issue with our court system is that it messes up. The advantage is that when it works properly, everyone has their rights protected. Do you not understand how court procedures work? This isn't the college board system. There are lawyers, strict rules, and the jury. You are acting as if college "courts" are how real courts work. You need evidence. In the case of an accusation then it needs to be backed up. I'll give an example. The rolling stones report on the false rape. Jackie's account of events was proven false. How? By trying to prove her account. The party never happened, etc. The fraternity actually won a defamation lawsuit against the rolling stone magazine.

The actress made an accusation. It was caught on tape. The police determined the accusation was credible. The prosecutors decided to press charges. The "evidence" was a video tape of him walking by her in a crowded subway.

If you could read your would notice I already mentioned there may be a lack of evidence. However in the Weinstein case there is plenty of evidence and more is mounting daily. Again you completely fail to understand how the American court system works. Both sides need to prove their side. The guilty must prove innocence with an alibi and the accuser needs to prove guilt with evidence. This is not that difficult to understand. I have no idea if Weinstein is innocent. I doubt it. However, to make these insane grasps at thin air to pretend he did nothing is ridiculous. The men's rights movement is not a conspiracy movement. We should not be wasting our time trying to defend Weinstein. He can do that himself in court.

About time. So you have one case where the judge failed an innocent man. What your article fails to show me was the accusation. If the accusation held up under scrutiny then she was an extremely good liar. My guess is that the judge was biased. It is a shame that the man went to jail but our court system is as good as it can be. Accusers need to be able to use their own accounts as evidence. Would you be singing the same tune if we were talking about the catholic church? Were all those young boys just supposed to give since there was no evidence beyond accusations? A bad judge is not evidence of a flaw in the system. It is evidence of human error. Maybe we should be arguing about keeping judges accountable to their decisions rather than eroding the rights of victims

Thats my entire point. Our court system is an ideal. It won't be perfect. Weinstein has enough money to afford good lawyers to defend himself. I have no doubt that the findings against him will be true. Whether that be innocent or guilty. However, the mrm should not be a conspiracy movement seeking to find innocence in men like Harvey. Instead our efforts should be focused on more important issues. An example would be the awful college review boards for rape, assault, etc.

It is a sensitive subject but I have seen it said that "beyond reasonable doubt" is translated as a target false conviction rate of one percent in practice. Or maybe it was two percent.

I agree some men are guilty, I even intially thought Weinstein was guilty, too, but then I started questioning it and digging and now I do not.

I do not represent the MRM in this, I admit this. But I will not give into peer pressure and abaddon what I believe to be true based on what I've seen so far.

Too many here get way too round up in the whole false accusation thing as if its some huge epidemic happening left and right. Its ridiculous. There are cases of false accusing but it's mostly on college campuses. To be honest. In my opinion if you are a guy and you have sex with a drunk girl then you fucked up. I'm saying its right to be accused of rape but you have to take responsibility. Drunk sex is now considered rape. Its time to adjust. In Harvey's case I doubt the accusations are false. Its not easy to get a conviction in court.

I never said every man is innocent, I know they aren't and those that aren't deserve the full brunt of justice, but all they have on Weinstein is accusations, his admission of sex addiction (I don't believe in sex addiction, its just what we call men now with a high libdo), and a context free audio open to interuptations.

Accusations are evidence whether you like it or not. If in court the accusations hold up then he will be found guilty. If he did use spies to silence his victims then he will be in even larger trouble. I see no point defending this man or even trying to pretend that he is anything short of a manipulator. Your attempts to make excuses for the use of paid spies is nonsense.

They are evidence, but they must be test, contested, and challenged in court and then compared to the defences evidence.

I'm not sure if I mentioned this to you but I agree with that. Obviously they must be tested. I think the American court system tends to do a good job of that. Small community courts tend to be less as good

I don't know anything specific about sex addiction and not a great deal about addiction in general but even I know sex addiction does not only apply to men.

It is easy to imagine how extremely high libido could be mis-diagnosed as sex addiction, but that does not mean sex addiction does not exist.

People who are predisposed to addiction can become addicted to a very wide range of things which have the required attributes. A strong reward is just one of them.
My guess is that some sex addicts don't have an unusually high libido, it is just that problematic sex meets some of their needs sufficiently and they don't have other ways to get those needs met, so that becomes the driving force of their addiction.

It's pretty standard to hire detectives to investigate the backgrounds of accusers to discredit them. Nothing new here.

I'd love to find out how many of his 'victims' were paid off and how much they sold the justice of their attacker for? I wouldn't believe a female who took a payoff

That is why financial settlements sometimes specify that the money is paid to a charity. Either the complainant genuinely does not want his money, or rejects it as an insult to him. By not profiting from the deal they avoid calling their motive into question.
I think I saw that arrangement mentioned by at least one of Weinstein's accusers.

Someone who has taken hush money for themselves is in a weaker moral position to make a public complaint, and presumably can be sued for breaking a formal or informal contract of silence. That doesn't mean they can't speak out, just that it may cost them.
If they gave the money to charity I don't see that their moral position is compromised at all, though they are still liable for breaking any contract of silence.

Someone who has paid hush money is in a weaker position to defend themselves but again it does not constitute evidence of guilt. Failure to sue for breach of a contract of silence is not evidence of guilt either.

Someone who accepts hush money in any form rather than seeking justice is not credible. If someone can be bought off for money once, there is no way of knowing if someone isn't paying them now to say something. Anyone who for goes justice is guilty in my eyes.

With rape, "seeking justice" seldom involves the police and courts. They have an important role in a minority of rapes but will never have any useful part to play in the great majority of rapes.

Some people talk about trying to modify police procedures and the law to enable them to get a grip on rape but only a limited amount can be done without abandoning basic legal protections and introducing gross injustice to the accused. In general, rape is too slippery for the courts to handle and the requirement for proof beyond reasonable doubt lets almost all rapists evade arrest, never mind conviction.

Rape seldom happens in real life. That is why 93% of rape accusations never result in conviction. It's impossible that 93% of men accused of rape are hyper intelligent enough to get away with it. The fact is that most females have no idea what rape actually is and are convinced that if they feel raped, then that have been raped. This is obviously not the case

Also some for people with long term / permanent damage from chronic severe abuse as children. Often the original damage wasn't sexual, but they are very attractive targets for abusers and outright rapists so that often gets added into the mix at some stage.

We spend a lot of time here discussing rape, consent, both genuine and false accusations, investigations, trials and sentencing.

HW is a relevant case for many of these subjects which concern us.

His story did not suddenly stop being relevant and interesting after it became evident to most people's judgement that he is a colossal sleazebag, an out-of-control habitual harasser (listen to the tape) and very possibly a serial rapist.

Holy shit, this is getting unreal, is hiring an private intelligence agency, going too far or should victims of false accusations be taking notes on how to clear ones name.

Still I think Farrow is spinning hard, I think what Black Cube was looking for wasn't extortion material, its was something to clear Weinsteins name, proof of his innocence, after all blackmail is illegal, its too high risk, if one can prove the blackmail, the people involved could go to jail.

It is easy to imagine there are several busloads of such women, plus a queue of failed applicants stretching around the block. But I don't see how any of that is relevant to the accusations he is facing. The accusations are not of miscommunication or misunderstanding, they are of outright predation.
