In case of proved false rape accusation, the arrest record and the name of the real proved victim in all reports (police, court, etc.) should be completely expunged.

He souldn't have to bear the consequences for something he's totally innocent of.

I don't know how everything works in the UK, I'm from Belgium, but here you would need your record clean for getting certain jobs and so.

Now, I don't think he's saying that record (if it sort of works the same there as here) will be affected since he was never convicted of anything, but he's saying that when a police officer stops him and looks him up, there will be a record in a wider database, and as such he has doubts about airports and more as well?

So I'm not sure exactly which searches will reflect the arrest. Would a background check show it when applying for a job? I don't know. Maybe.

I believe their record system is similar to Canada's where police/arrest/mental health records are not expunged.

There is an actual logical reason for it, it's to ensure those that escape justice through loopholes in the court system are continued to be scrutinised by enforcement agencies when further involvement with the individual occurs often to assist with repeat or serial offenders, or to provide fore-warning to law enforcement officers in regards to safety. This has the unfortunate effect that people can never be absolved of their police record even when they absolutely had no involvement in a crime or even if a crime actually occurred and that the process to completely expunge police records means you have to apply to have it appealed through each agency.

It may have the effect of some individuals are unjustly scrutinised, but because the policy covers certain mental health records as well--it does assist police in safe interaction with known disturbed individuals. The police organisations that lobby for the practice's subsistence really pay no attention to collateral damage even when it is their own staff that ends up in the sling--but those staff members do have easier access to the process of removing those records through appeal which the general public does not.

What is rather unfortunate is that the records the officer is referring to are records held within his own organisation and are a result of the policies of the organisation he aligns himself with. In some ways, there's a sliver of it being his own misfortune should it be the case that he ever directly supported or relied on the policy at any given time that assisted with his safety when interacting with known dangerous persons. Perhaps it should shed light on the fact that such records are damaging when erroneous and especially damaging such in the case with Canada's approach where those records are accessible by prospective employers et al.

Yes. And there is no time-related automatic expunging of the record.

Odd, I’m from Ontario and had my arrest record and fingerprints destroyed upon formal request. Has this changed recently? I had it done several years ago now. I’ve travelled to the US several times without issue and have worked in the big five as well as the major banks. Not once was my background check ever brought into question. Some of these were more than your usual enhanced reliability checks too.

Yes, you had to apply.

Even applying is not concrete that it will be approved. If you don't apply then they will not automatically remove your records as their assumption is you should be aware that the records exist and that not requesting the records be destroyed is considered 'no contest' to their use.

But I’ve been back and forth several times since then without issue so I guess my request to get my info expunged was completed.

At the very least, even if it is not expunged, an "acquitted with overwhelming evidence in his/her favor" seal over the case should be accepted as a clean record equivalent.

They are not, an arrest in an arrest, if you are innocent or guilty it's the same. And his record will always show "Arrest for sexual assault charges"...

The only case when the record is expunged is for minors (as underage) I think.

I am fucking sick to my core that modern gender politics has amounted to playing your life ruining trump cards whenever you feel scorned, and truly believe that anybody who supports actions like this to further their own political agenda are purely malevolent people to whom worse is punishments are deserved.

While I agree, judges can not give someone however much time in jail/prison that they want. They have a set of guidlines with maximum/minimum time they can give based on the offense.
