The cloistered lunatic behind this push to upend the presumption of innocence and give women the ability to turn courts into the 21st century version of the Crucible is one Stephen Schulhofer, a professor of law at NYU. Schulhofer is one of the many legal academics who has never actually practiced any law, but presumes to tell actual lawyers who represent actual clients whose freedom is at stake, and lawyers who have to decide whether or not to prosecute people, how to practice criminal law. Insofar as I can tell, Schulhofer has never actually litigated a case, but he has done plenty of "scholarship" on it, which is not even remotely the same thing. Since the mid-90s, Schulhofer has been in the feminist camp for expanding the definition of rape.

The other law professor behind this madness is Erin E. Murphy, also of NYU Law. Unlike Schulhofer, Murphy actually has some experience serving as Public Defender in D.C. However, despite being knee deep in the bullshit that defendants get when they attempt to exercise their rights, she opts to place the sanctity of the sisterhood above such trivialities as due process and the presumption of innocence.

This is what in large part, is wrong with the law today. Taking advice from legal academics, most of whom have never tried a criminal case, is like taking advice from a Catholic priest on how to eat pussy; they have no practical or useful experience on the subject, their ideas are not practical to the administration of justice, and their legal regimes, like affirmative consent, are not comprehensible to either those who must enforce it (police, trial lawyers, trial judges) or those who it must be enforced upon (men).

This makes no sense at all. Consent is not a one time thing. It's continuous. And it would be impossible to prove consent throughout the entire encounter. Except maybe a signed document after the fact that both parties were consenting the entire time.

And there is no way to prove it because consent can be removed at any point..... So basically you're guilty just by being accused, and the only way out is to prove you never had sex. Nice.
