Sure. It doesn't get fairer than lifelong alimony based on the current income of the partner that earns more.

It is offensive to me to hear men or women say they can't retire because they can't afford to retire if they have to pay a fraction of their income for tax-deductible alimony

So, while the half is indeed a fraction, phrasing it this way is a little bit dishonest, isn't it?

They are not allowed to receive alimony for savings under current law without reform

So all of the savings go to the partner that has to pay alimony in case of divorce? I didn't know that. I guess it isn't true, though.

The pending bills aim to make timesharing of children equal for the same reasons. More timesharing equals less financial support

Don't allow women's rights to be trampled simply because rich men have organized and are convincing people that they are disenfranchised without any empirical or economic data to support their theories

Let's pretend it is the rich people that profit from this the most (which in absolute numbers may be true; i.e. number of $ paid), they are not the ones that struggle in the aftermath of divorce.

Marriage, alimony and custody are in deep need of reform. Yes, it will hurt women most, not because their rights are trampled, but because their privileges are.

I'll tell you what really hurts women and children: all these laws supporting single moms. if you're a single mom you'll get free college tuition and your kids will get free college tuition. you'll get free housing and free food and free spending money.

basically you've found another father to your kids, his name is Uncle Sam, he pays really well and so there's no need to find another.

only problem is he'll never teach your kid to Be A Man, he'll never explain the difference between Right And Wrong, and he'll never be that Second Opinion which I feel is necessary in every home.

But that is income at the time of the divorce, right? So if a guy is making $120K when he gets divorced, the lifetime alimony award is limited to $5K/month ($60k/year). But that $60K becomes pretty damn difficult to pay when you lose your job or want to retire, but, for some reason,

If fairness were the desired result, the solution would then be simple: just equalize net income for a period equal to the length of the marriage.

here is how alimony should be handled nation wide.... its fucking simple.

Terms are gender neutral.

Qualifiers Yes No
Did the marriage result in Birthed or mutually adopted Children Alimony awarded Alimony not awarded
Does Primary care spouse have a 2 year degree equivalent or higher Alimony Term = 6 years Minus total Years of college Completed (minimum of 1 year) Alimony Term = 4-6 years at judges discretion(maximum of 6 years)
Did Primary care spouse have income during the Child care process at least one year prior to the divorce Annual alimony = ((Net Primary Earner income+ Net PCS Income)/2)- Net PCSincome) = Annual alimony paymeny, AAP/12= Monthly alimony payment. Example 75k/yr Net Primary earner income & 25k/Yr net Primary Care Income = (75k+25k)=100k/2= 50k- 25k= 25k total Annual Almiony Payment, 25k/12 = 2,080/Month. Alimony = 50% of primary earning Spouses Current net income- adjustable with current net incomes for alimony term.
Was either spouse declared permanently disabled and incapable of earning wage during the course of (not prior to) the marriage as result of non controllable events (I.e Morbid obesity is controllable, and would not qualify) all previous alimony rules are invalid. Spouse is awarded a life long 50% alimony. no special exception granted.

These terms would ensure that

  1. Life time alimony goes away
  2. The lesser earning spouse is forced to stand on their own two feet after a reasonable period of time in which they could reasonably obtain a college education AND a job.
  3. Alimony is only granted if Children came as a result of the marriage, as the "Sacrificial" element of the alimony claims can only come about as result of. (born or adopted) were a part of the marriage (previous marriage, and illegitimate children do not qualify. Adoption of previous marriage children counts as adoption.)
  4. this also prevents unbalanced alimony payments to spouses with the capacity for earning a wage.
  5. this prevents a partner from discarding their spouse because they became disfigured or maimed in the course of working. I.E. if a soldier comes back from war, and is permanently maimed as a result and cant earn a wage, the spouse is responsible for caring for them financially.
  6. this also prevents instances where the combined spousal income + Alimony does not exceed the primary earners wages as it does in many cases.

Why should there be any restrictions or penalties here? If someone wants to be separated physically, emotionally and legally from another person for ANY reason, be it not liking they put ketchup on their KD or that they have become very emotionally unstable requiring constant care, why should they be penalized for it?

Now, sure many might see it as an asshole thing to do, but so what ?

If during the course of my marriage my wife leaves work, refuses to work anymore, spirals into depression making my life hell and is incapable of supporting herself now , am I expected to have to live with that burden forever, even after a divorce for the rest of my life?

Hell no.

Alimony should almost never happen, and when it goes for a very brief period of time, either enough for the person to get on their feet/reeducated (couple of years) or until alternate care methods (possibly state provided) can be put into place.

i agree. did you read the example tho? i'm talking about where a spouse has become physically or mentally crippled. you dont get to just abandon someone you swore to care for through sickness and health because they cant physically or mentally perform anymore. on mental health i am refering to things like brain damage, retardation, and other things that would have you qualified as an invalid by the state. this is expecially geared towards the military spouses that abandon their partners after they return from the service with extreme physical or mental handicaps, and just dump them in a VA Care facility because they are no longer a convenient sex toy/meal ticket.

it is exceedingly fair, and accounts for the major factors in a divorce, and can be applied to either gender without unfairly harming either party.
