Women are above the law.

Even HuffPo published the information about the sentencing gap in which men receive sentences that are 63% longer than sentences for women for the same crimes.

Let's think about that...

If men get sentences that are 63% longer, then women receive sentences that are (100/163) = 0.613, 61% of those that men receive.

If we use 61% as the general discount, we have a way of modeling the expected prison population, given a hypothesis that men and women commit crime at the same or similar rates.

Estimator of women's discount in criminal matters = .613

Steps in the criminal process: 1) Suspicion (is a person even suspected of a crime, 2) Investigation (once suspected, is a person investigated for the crime), 3) Arrest (once under investigation, is the person charged with the crime), 4) Trial (adjudication of the person's guilt), 5) Sentencing (is the person sent to prison and for how long)

Estimate of likelihood of a female ending up in prison, relative to a man, given the 5 steps above:

0.613⁵ = 0.0869; So, given this simple discount model we predict that for every 100 men in prison, we would have 8.7 women, even if women commit criminal acts at the same rates and severities as men.

What is the reality in American prisons:

The number of Men/Women in prison per 100,000 is easy to find: Female: 126 per 100,000, Male: 1352 per 100,000

This means that women are 126/(126+1352) = 0.0852, 8.5% of the people incarcerated. So, for every 100 men incarcerated, we have 100* (126/1352) = 9.3 women

If we look at the ratio of predicted to actual: 0.0869/0.093 = 0.932

So, to sum up. Using the sentencing discount as a general estimator of female advantage in the criminal process leads to a prediction that is less than 7% different than reality.

This means: If women commit crimes at exactly the same rate and severity as men, a 61% discount in the process [as proven to exist in sentencing] leads to the current ratio of genders in the prison population.

To that, add the lack of criminalization of specific crimes when committed by women against men: rape, paternity fraud, theft in relationships, domestic violence and even murder, and you have a level of bias wherein the criminal system could be said to exist for men alone.

Relative to men, for every 9 women sentenced to prison, 91 walk free. For every woman in prison, 10 walk free with no punishment by incarceration. For men we have the innocence project. For women, we need a "guilt project".

Women are simply above the law.

Of course, if I were to point out that the prison population was disproportionately African American, and claim it is because African-Americans are inherently criminal, then I would be rightly shouted down as a racist.

OTOH, if I point out that the prison population is disproportionately male and claim that it is because males are inherently criminal, then society says 'Right on!' Those men really are criminal bastards!'.

Few people seem to think that the disproportionate number of males in prison may because the judicial system is slanted against men and in favor of women. That is something they don't want to hear.

But African Americans represt almost 50% of the american prison population. Of course this does not take into account that judges rarely send white people to prison.

Is it hate speech yet? How come its perfectly acceptable to assume that just because men are over represented in the prison population, that its because men are more prone to crime than women. But if you switched it around to suggest that minorities such as Africans or natives are over represented into the prison system because they commit more crime, is hate speech.

Are men natural more criminals? No I don't think so. Are there more male criminals than female criminals? Yeah I think so.

Yeah it does not take in account the pussy pass but even if you do it does not make up for the majority of male criminals. Crime, from my limited knowledge, correlates well with wealth. Crime is higher in poorer areas and very rare for middle-class and upper/middle-class males to commit crime. The same question could be poised as "are black men natural born criminals?" and the answer is still no. But you will see crime rates are higher in poor neighborhoods which may or may not have poor black people.

Then the logical question to ask is why poor women are not committing crimes as often as poor men are?

While it is true that poor women will commit crimes more often than wealthy women, we still do not see poor women committing crimes at the same rate poor men are. Is it because men are more violent than women? I don't have the knowledge to dispute that.

Of course crime rises in a group of people where every individual is basically left to fend for himself. What I'm saying is that women have much less incentive to become criminal with emotional and financial help and support being much more easily accessible to them. Since ancient times, mind you.

And of course, female hypoagency, pussy pass in this case, also leads to a a pretty significant amount of criminal women flying under the radar.

However, with all things said, I admit that agression potential is naturally higher in men. Just not nearly as much as this article or the general anti-male bias claims it to be.

Let's look at rape. We know (from surveys which are endorsed by the other side) that women rape men at about the same rate as vice versa, but the ratio of female rapists of men being locked away, to male rapists of women, is..... completely unknown but probably around 1 to 1000 or 10,000.

The prejudice is in not locking up or even prosecuting female criminals.

Think of a venn diagram, with two circles overlapping each other partially.

One circle is the set of behaviors men would come up with to interact as harmoniously as possible given a set of nature.

The other circle is the set of behaviors that are legally sanctioned. The disparity between the two is a legal bias against male behaviors.

To name some simple examples of behaviors which are illegal but (IMO) okay:

Driving when you've had one beer.
Punching someone who is being willfully disruptive and causing others grief.
Using your own money to buy business suits or maybe a car so you can move up in the corporate world, choosing to invest what you've got now to earn more later. With child support stopping payments for any reason is imprisonable.
Hooking up with someone after you've both been drinking
Defending or retaliating (immediate retaliation, not revenge) against someone who has attacked you with a weapon
Cussing at people when you're angry. Using curse words is legally considered to be threatening behavior and can result in a restraining order.

So yes, men may be "natural born criminals", but only in a given legal context.

Imagine a society in which it was illegal to:

Sleep with someone else outside of marriage
Put someone's name on a birth certificate as father without a DNA-based paternity test
Circumcise your children
Engage in emotional abuse such as gaslighting, or hiding things to make a person think they misplaced them, or sobbing when someone else comes to you with a grievance.
Prevent a boy from standing while peeing
Text while driving
Slap men (as a woman)
Lie about taking birth control

In that society, which made those acts illegal, would women be "natural born criminals"?

There are the obvious short term benefits of this, but in the bigger picture it causes women to not be taken seriously and thought of as incapable of making clear decisions or having in sense in business or in any important positions anywhere. "We should treat men as more suspect than women, prosecute them more often, and send them to jail for longer. Why? Because men are more violent. It's obvious, just look at how many men are in jail."

They would have no problem seeing this if the standard was applied positively to men.

"We should treat men as more capable, promote them more often, send them to college more. Why? Because men are more productive, just look at how many men are CEOs."

Or perhaps, we should acknowledge that gender statistics should not guide policies.

80 percent of men are there for victimless crimes, like smoking pot, dealing drugs or not paying taxes. I mean, let's be objective. How many women go to prison when they hit their infant children? What if it WAS punishable? I am sure the number would be a reverse.

Ignoring for a second the additional motivations that men would be subject to that would lead to a criminal offence(like, being expected to provide for their family even when they don't have the means to, being expected to be strong and defend women, or the added burdens that would lead more men to drugs and other substances), there is still a major disparity in sentencing too.

100 women commit a crime, they are each given a week of jail time as a sentence. 100 men commit that same crime, they are each given a year of jail time as a sentence.

At any given point, there would be considerably more men in that jail. Does that mean that men are natural born criminals? No. It does not.
