Hear me out. Ex and I legally separated middle of last year, signed a temp custody order and both moved to a new state the same month. Specifically in that temp custody order was a clause that required the temp custody order to be registered in the new state within 30 days. My ex has refused to do that, and here we are 8 months later with the same temp custody order, she's not complying with and I cannot file for divorce or a parenting plan (custody) order until the order in the old state is waived or dismissed.

I've had my kid(s) now for 22 of the last 26 days. However she is still refusing to sign the paperwork to transfer the case to our new state (8 months now), and I've been paying obnoxious legal fees in two states to try and get things finalized. She was the one who wanted the divorce, but is doing everything possible to stay married now. I haven't seen her in weeks, but she wants her child support payment now. I've only missed this one month.

Am I wrong for thinking if she doesn't have to comply with the temp custody order, why do I? It's not registered in this state and not valid here either. I just want all this behind me so I can file for the divorce and move on with my life. It's hurting our kid(s) and I've had them in therapy for over 6 months now.
