Texas is a community property state. Anything earned during marriage is to be split in a just and right manner. That means it’s not quite 50/50 but rather the lower earner gets a little bit more. 5 year marriage = no alimony. No kids = no child support.

Anything you had prior to date of marriage is separate property and the court can’t divide that amount.

File first with your narrative showing you want 50/50 of community assets.

60 day waiting period. Be careful that she doesn’t get coached by her attorney to claim domestic violence. Texas is no fault state but DV charges will get her the upper hand.

File first, then record all conversations and interactions until divorce is final.

One other thing to note is that Texas judges prefer mediation route. A mediated settlement agreement is binding in Texas and judges can’t change it unless it impacts children or severely biased. So if you want all this to move quick, get her to understand that attorneys will milk you both dry and you’ll waste thousands on attorney fees. Mediation is preferred and cheaper. You still have to do all the financials and turn in all the statements first, then you both can attend mediation and settle on the terms. Doesn’t matter how much she saved up or how much you saved up during the marriage. It’s all one big pot that belongs to both of you. Debt is the same way. Any debt incurred during marriage by one party is owned by both. Including attorney debt! Keep that last tidbit in mind. Racking up attorney debt is community debt in texas and will be split.

I second the mediation route. One option if you can stomach it is to work together with your ex and with a financial planner. Then when you have agreed to everything you have a single lawyer draw up the decree. Your situation doesn’t sound complex and you save $$$$ on legal fees (one attorney with not much to do but make a document). As somebody pointed out, there’s often 95% that is easy to agree, and 5% that are hot button items that can explode at the n’th hour.

Lawyers only represent one person. So, my ex’s lawyer drew up the decree and I did have my own lawyer check it over. Only used a couple of hours of their time.

I actually did some therapy with my ex first to put to bed the emotional stuff. When it became time to deal with the financial we could approach things calmly. It was mostly smooth sailing for me.
