Yes you can get child support orders even from someone who is unemployed. At least you can in CA. The courts will impute her income based on what she could potentially earn given her skill sets, degrees, previous employment, etc. Doesn’t mean you’ll actually see any money until she actually gets a job so that you have somewhere to send the garnishment order.

Though I am not necessarily looking for child support depending on how the judge rules when we go to court, I am wondering about spousal support. The reason is that she has an advanced degree higher than I do and LOTS of well paying job prospects. In the last 10 months she has not found a job but instead has made the time to find a new relationship and spend as much of her free time effing this dude.

I hope you get child support and anything else that is fair or within the law. I think my stbxw has it in her mind that she will just get spousal support till the kids are 18 as well as child support. I guess we'll see what the judge says.

Yes, you can obtain an order for her to pay child support. Whether it ends up being collectible or whether the arrearage grows toward infinity is a different story. Get the order, use the lever.

Yup file for it ASAP and it should get backdated even if she can't pay now.
