Not sure about where you are but in California support is determined by a formula based on income & expense declarations filled out by both parents. The figures are put into the Dissomaster program and it spits out a number. Judges vary rarely deviate from it. The more income you have, the more support you are able to provide and that’s usually what happens.

She will get an increase, no doubt. Odd how when your salary goes up they can find a way to suck off of that immediately, but when the well runs dry, it takes months to stave off the trickle.

It is unclear from your post but you imply that the Ex does not have an income (you say that while together she did not, and make no mention of the current situation), so be sure that you are using an imputed income for her if either she has none, or is under employed. Your attorney can help you bring that issue up so that the sting is a bit less.

Child support is wrong if the split is 50/50 if they really wanted the best interest of the child they would give full custody to the parent with the most income along with taking into account other factors such as the possibility of abuse.

Get ready for a fight. Get a lawyer with a backbone and fight it. I'd be trying to prove she doesn't need as much money since the first two kids are older and on their own. This is not the 1950s and she should be able to get a job unless she disabled. You have to work and so should she. You know equality and all. There's no circumstances why you should have to fund her lifestyle only support the children. My ex has tried to reopen the divorce for God know what reason. Hell she didn't show up now she's butt hurt. That was two years ago. I'd say her chances are slim. I'd cite the previous decision in court and destroy her justification for more money. If she needed the money more than you they wouldn't have lowered it. Fuck that bitch and any woman like them. Just bc you pop out a few kids does not entitle a woman to your pockets for life. No one deserves to benefit from your work but you. Especially in today's society where they get to destroy their homes for selfish reasons and benefit from it. The nerve of these women. Just be happy with you get. They don't see the other where you have to grind and they don't care. They get support tax free. My ex, her parents, and a few family members have health problems and call on me. I used to be that guy.Do you don't I help now?.....nope fuck em. All of them had a hand in my divorce. Karam is a bitch and I'm fighting everything that comes my way. We should haven't to but we gotta fight the bitches to keep our kill. We gotta fight for our kids too. I wish I had money to give to help you. I've been where you are. I don't have alimony but ex.is trying even after the divorce was finalized years ago and the kids aren't eligible for an increase for another 2 years. They'll be grown by then.

Here in Pennsylvania child support starts and ends on the date filed…. That means that if it goes up then you owe the difference from when they filed not when the court rules. The inverse can also occur.

If I were you I’d make sure they realize that you paid more than your fair share for months while your income was drastically reduced. You should get a credit for that.

Also two of the kids are out of the house now. What about the other two? How old are they? You could make the argument that she can now work ‘some’ and you shouldn’t have to pay as much to support her.

Finally this right here is reason 273749 that you do not let your significant other stay at home. You will get killed in a divorce. You may as well be having an affair in the office. Either way you don’t own your balls anymore.

Don't know the answer to this, maybe somebody with knowledge of it can chime in. Child support is determined based on the differences in income at the time of divorce to equally distribute the financials to keep the kids quality of life relatively the same. The real reason is to keep an individual parent out of the welfare system, many judges who are elected frequently campaign and advertise their high number of support orders because states are given federal dollars based on how many support orders were issued. Your first go around makes sense because your income went down so you can't be expected to pay based on a salary you no longer make. At this point enough time has passed that there shouldn't be an order to return the standard of living decided on years ago but I honestly don't know.
