Sorry if this is been covered before. I am 9 months into the divorce process. My wife is trying to change my son's (3.5) last name to include both hers and my last name, she asked for that in mediation and we said it was an absolute no and she could file a motion with the court prior to the hearing. Also they say the name would be hyphenated. When we were married she dropped her father's last name because she didn't have much attachment to that name, her words (instead her middle name was changed to her grandmother's maiden name). She subsequently had her name changed already by the court (prior to my son learning to say his real last name). My lawyer says that there's no benefit to the child so the judge won't grant it. The first day our son learned his last name in school he came home and told us, at which point she started telling our son his last name is what her last name is. This has been going on for months. I don't want to confuse him any more than is necessary, but when people ask he will randomly pick one of our last names and I get plenty of sideways looks from people, especially at his school.
