I did not get Child support majority of my child’s raising. An occasional income tax return that was garnished ridiculously small and extremely rare occasions. The non custodial parent would job hop and work under the table to keep under the radar. I was greatly surprised 2 years ago when I began getting payments from Tx Attorney General from steady wage garnishment from my ex. Large steady payments. Approx 525. To 675. Bi-weekly. My child was 39 at the time. Needless to say my ex contacted me to ask me to please tell them I did not want the money that our child is grown. Not a chance. Negations stopped when he refused to see our child, help with any of her needs and cared less if she was ok. Hang in there, it may take a very long time.. mine did but Ken Paxton and the office of the Attorney General did an amazing job for me.

I worry about this too!

I've gotten a raise every 6 months so far since the divorce started and not said a word. It's not a lot, but I'm in the trades. I make 6K more already than when the judgment passed.

I'm on the receiving end BTW.

With 50/50 and her insuring the kids (2), in my state, I get a measly $530 a month. I say measly because all us Dads in the real world know that only gets you groceries for the 2 weeks you have them. Maybe a little left over if you skimp.

I'm afraid Miss Money-Tight-Ass (who still makes 2.5X what I do) will bring me back in for an evaluation.

How did she find out you made more? The proof is on her to provide a reliable source, I believe you can simply tell the court, the previous order was fair.

I’m going through this in the opposite direction right now. In my state you are supposed to update your new income within a week. It even says it’s ’your duty’ to do so.

My ex, who now makes, I assume, substantially more than she was making also did not report her change of income. The law says up to filing in my state but I’m going to try and get it from the nearly 2 years ago when she started the new job.

I can give you some advice. Have you been keeping your dependent(s) more than required? Is your ex often times late for pickup? Have you been buying a lot of things for your kids? That’s evidence and may help you when it comes to lowering your support burden. Also who pays insurance?

I have 3 kids if that matters. One will graduate this year, another next year but in the decree I pay for my youngest until I die.

Generally retroactive support will go back to the date of filing.

If you’re making more you can assume you’ll probably have to pay more. But Yeah, the online sources aren’t clear on the retroactive part. The gist of it is that modification proceedings are less likely to result in retroactive support than initial proceedings. Have you reviewed your order? Does it put you under an obligation to report or declare changes in income? Anything like that?
