I’ve been trying to finalize my divorce for years we were married for three months before I filed divorce we have a son and she moved not even interested in divorcing me just humiliation for her happiness. Get that lawyer and get that money!

Lots of bad information on this because the law in California has changed a few times over the past decade on this issue. For asset/community property issues, the marriage “ends” when 1 party to the marriage decides it does and takes action consistent with that decision. It does not require physical separation. It can be very simple: you a) decide the marriage is over, and b) tell your spouse that you want a divorce. (Decision + action) It gets complicated when a & b happen, but then conflicting actions follow, like attempts at reconciliation. However, it is frequently the case that the parties do not agree on the date of a & b. In my case, the date seemed crystal clear—she said she wanted a divorce and never wavered. And she was fine with “May 28” as the end of the marriage, right up until she realized the economic consequences of that date when we started asset division in mediation. Then suddenly she tried to make the end of marriage MUCH later. Fortunately, I had all the receipts—wrote in my personal journal, phone records of friends/family I had called to tell them about the news, etc…and she was stuck with that date.

In my state, the date of separation is one one party moved out with the intention of not coming back.

So, you could file for divorce my state at any time now. My ex wife did the move out and say for months she’s ’thinking about it’ then filed for divorce when she was ready without ever actually asking me for one

I’m in cali. Separation date can be whatever both parties agree to (in a mediated case) but will likely be very contentious because of asset splitting.

In my case, marriage was already declining in 2018. Didn’t file until 2022. So we agreed to 2020.

In my state the date of separation is the date when you were permanently no longer cohabitating. If they moved back at any point, even if for a few days the clock resets.

This is also something that would need to be agreed upon by both parties. I was able to negotiate a date that was a month out from my expectation. In the grand scheme of things a month isn't a big deal.
