Some states you have to be selected for 6 months up to a year and still live in the same house if she walks out she can be held as abandonment. And that wouldn't be good on her part I think in the UK it's 2 years you have to live under the same roof while separated.

But if you get an asshole of a judge? Maybe…

In my divorce, my exwife tried to put down that since I used to get a lot of overtime at my job, it should be factored in that I “could” work a second job. Whereas she said she was “too sick to work” any job, not even part time.

Luckily my judge told her she was faking it, and didn’t penalize me for my ability to get OT hours or the ability I had to work a second job.
