It’s a terrible law. Puts men at a disadvantage, given favoritism to mothers re custody.

This is why I generally favor no-fault divorce. If one party says it’s done — it’s done. No hoops, no hurdles, no administrative state bullshit, all of which delays the inevitable while adding greatly to the cost. If someone wants to leave the marriage, that is it. Cut, dried, done.

From what I know of NC, you have to leave, or at least have to prove that you had a separate residence for 366 days. But what you CAN do during this period is to get a temporary custody order, so that you aren't just walking away from your children. A lawyer can help you with that.

Definitely consult an attorney about this. Work out a custody plan for the separation, ideally 50-50 if it is possible to do so and there are no safety concerns. This will help to create a baseline.
