Mediation is just a psych out for the real thing and don't ever do private mediation I made that mistake 5k and had full agreement and ex walked away at the last second

Don’t fold on anything. Mediation in my experience is suspect. They are usually just interested in getting parties to sign irrespective of outcome fairness. So you have to demonstrate you are confident and will not cave. 50/50 is becoming a new normal ex any issues with location or behavior issues.

The mediator may agree to your proposals and help steer it that way. As simple as, “this is the likely deal in court.” I would go without lawyers to save money. If you have to pay a lawyer $5k to offer the same deal she’s already rejected it doesn’t make sense.

I agree if you want that 50% and the geographic condition, get that deal. Don’t fold. Take it all the way to trial if you must.

If there’s no reason you shouldn’t have 50-50, stand your ground. Rules for changing geographic location is written in code, so there are rules and a process.

Mediation can be a process of breaking one party only in the interest of settling the divorce, not in any other interest. My opinion: you may not have a friend in the room. Mediators, GALs, and both lawyers could have an agenda to settle rather than act in your or your kid’s best interest, and because everything in mediation is confidential, any behavior is allowable. My experience was that I should have treated the process like I was in an interrogation room.

Also, careful what you say. “Yeah” or “OK” can lock you in.

Alot of places have mandatory mediation before you get to go to court. If you go in and say I want 50/50 week on week off and kid stays here. She says no. Then you say this is where I'm at, I'm not moving. They declare an impasse and you are closer to getting in front of a judge.

Mediation is easy to derail. Kids would do it. If you've already paid, or are on the hook to pay, yeah, why not show up.
