Status quo is the greatest bias of the court. You are doing all of the heavy lifting with the kids. You stay the course and get those temporary orders in place. Do not move to her, or you will forever be following her to parent your children until adulthood.

Your being naive if you think she is not having an affair after being separate for 7 months.

You need to file and protect the kids.

Document document document Hard evidence. If the kids are in high school they can decide where to sty and they have an impact with judge.

Print your phone records and show her lack of calling. Print emails where she says she can’t come see the kids If she is not helping with $$! Print the back records showing a lack of assistance

You want to nail it down. Having evidence is what judges like. Makes it easier for them. “Your honor here is the phone records for the last 6 months. She has called twice in that time and I have high lighted the calls” “Your honor here are texts concerning (her) refusing to contribute to support our kids needs. I have included in this evidence the money she has sent totaling $500 over the last 6 months.
“Your honor here is the mail she has sent the kids the last 6 months. I wish there was some but she never sent even a card to the children.”

I don't know where you live but courts don't like kids moving at all when the divorce is not finalized. It creates a jurisdiction issue especially if you move to a different state. I would focus on getting the divorce finalized...than you can move anywhere you want especially if she is already states away.

I am so impressed by this community. If I had come here before initiating my divorce (last week of March 2022) things could have gone better for me. As it stands my childless abortus of a marriage is legally over but she sits on the bulk of my assets….until the court decides to recognize that she never could have refi’d to begin with etc.

Judges like evidence (and in CO, hunting). Give the judge evidence. Highlight the pertinent stuff. Listen to the singed learned lean elders here.

You might feel the need to come up with a strong new strategy to counter her rental to mommy. Maybe just keep being the best dad you can, and take time and money to develop your ownself.
