I wanted to file separately, but the problem I ran into was we needed to exchange information on our earnings (though this may have been because we lived in CA, a community property state).

If you have a joint bank account the bank has both of you SSNs and you can ask the bank to see what they have.

You just file separately. You don't have to file with her at all.

Depending on if she worked, it may cost you more (my ex didn't work, so filing alone the first year cost me 5k) but if she doesn't want to even co-operate that much, you're probably not going to have much luck.

You can file "married filing separately" in any year, without her notice or approval. If your ex is incommunicado, file your own taxes.

You can file married but separate. If your divorce is not yet final and you owe because she will not answer your requests, you can ASK for her to pay part of the taxes. If SHE files married but separate and SHE owes, it will probably be a wash most likely. If either of you get money back it will likely be split in the divorce.

Also, it will depend on when the divorce was filed and served in most jdxs. After service or separation your money is separate so that can have an impact

See a tax expert to make sure what you are doing. You may need to file for an extension.
