You already have a custody order in place? And she wants half of her cost to mod it?

If don't want to mod it, play a bit of hardball... Have your lawyer file to set the CS at what it should be based on your current pay stubs, and have them include those stubs in the filing, and say that nothing has changed for custody to change, then request she pay 100% of your legal fees, since all of this shit could have been handled without going to court.

Depends on the State but I had to pay my own legal bills up until the mediated settlement agreement. My ex decided to try and switch up on things we already settled and I hired another attorney to handle it. It turns out she owes me half of the legal fees from settlement on out. I wasn’t aware of this, my attorney told me. I don’t know your situation (who will be awarded primary custody) but it seems to vary by State. My ex owes CS and refuses to pay it. I’m not sure why she would believe she’s entitled to ignore a court order (actually two) but she now has two contempt charges waiting for her.

If it’s legal in your State, record everything no matter how benign. I do, always have in any legal matter not just her. My ex just can’t stop running her mouth and I recorded her stating she will never pay CS because she thinks it’s BS and the Court can’t force her.

Turns out she’s wrong. Say goodbye to her drivers license, registration and any tax refund headed her way. I would rather she spend the money fixing her own life but she would rather play stupid games because she thinks she’s smarter than everyone else. I haven’t bothered to tell her what’s headed her way, she can find out the hard way.

I’m not sure your STBX can sue for half the fees, it’s too open-ended.

Yes i went through this and countless lies from a pathological liar. 3 years later, countless false cps complaints, multiple false police reports, 5 false order of protection and violations. 100k (combined) in the hole to litigation and nothing to show for it. The most important advice i can give you is to run the show. Dont let lawyers and judges do it. If your kids are too little then youre not likely to be able to run the show. If they are mature and are able to decide how to split their parenting time then youre in luck. One of the best decisions i made was to approach my kids directly and clue them in entirely and against the courts manadate of keeping them in the dark. They dont know how much of a pathological luar their mommy is and i avoid alienating her but my kids are previe to whats going on in court and that they make the decisions about who to love and how often. This helped me immensely and the lawyers were powerless to stop me from taking back my 50%. I was that guy that did everything against the grain. Left my own house promptly. Started dating immediately. My mouth and words were unfiltered in the court app. Countless lies later and i am back to 50% overnights and now she fears i will take more than 50% and seek child support from her. The courts and lawyers are not interested in your kids well being. If they were, i would have been divorced in one hour not 2 dozen court meets later and nothing to show for it, never having seen the judge yet. Remember this term and it should give you all the info you need "court clerk circle jerk". And you will be jerked around if u let them. They are after your money, nothing else. Its not just your wife that wants you yo bend over. The lawyers and judges want the same and they will instill fear of losing your kids to facilitate you bending over. Your only way out, is to create assurance that you will not lose the kids and your desired quantity of time with them. The quickest and least expensive way to it, is to always be honest and remember you can speak to them freely without fearing any gag order.
