Sort answer is most likely?? The courts can not anything they want. But what you are referring to is called imputing. The court will imput both of you. This is not how much money you actually make, but how much they believe you could/should make, and then calculate everything from there. So it's possible (and even probable) that they will imput her to full time, given she needs more money as a single person.

HOWEVER, this is affects only part of the child support calculation. It affects spousal support / alimony more. Spousal support is based on her needs and your ability to pay. The more she makes the less she gets.

Child support is based on the needs of the child. This will be calculated and number will be generated. Then you have to determine custody (normally 50/50 in most states but check if that's something you have to fight for). And then determine residency (5225, 7/7, etc). In theory you both owe each other child support. BUT in actually practice child support is paid by the parent when the child is NOT at their residency. So it's you also have 50/50 residency they often no child support, or greatly reduced. IF she has primary residency then additional child support paid to her.

Talk to a local lawyer because things can get confusing quickly. Just understand that there are 3 things in play and ALL are seperate: division of assets/debts, spousal support, child support. You can negotiate how assets are distributed and spousal support, you can NOT negotiate child support because it's (suppose to me) for the child.

She’ll be expected to work full time assuming you get 50% custody. If she only works part time, the court will still put in a full time salary into the CS calculator. It’s called “imputing jet income”

Separation? As in you moved out? Move back into the marital home ASAP. She has no reason to reach a reasonable settlement if she's got your house, your money, and no you around.

Nobody can sort anything out in a separation but other people. One of you will never get over the guy she sees during the separation.
