I live in a joint property, no fault state. Divorce not final.
The child support worksheet was prepared by her attorney last October. Basically had me paying $1000 per month in child support. On it was some incorrect information that I pointed out to her attorney. The amount claimed in annual health care premiums was 4-5x what it should be.
It didn’t move much from here.
I got a new job earlier in the year. Pays more. Her attorney demanded new pay stubs. Fine. I also sent in my 401k statements because the markets have frantically moved in 7 months. If we are splitting, she’d owe me $175-185k.
I get back a new child support request saying my new amount would be $1300. But, they’ll make it $1000 if I don’t take about $50k of her 401k.
The worksheet still has the wrong data.
I highly suspect that the near $5k annual difference is about the amount she was hoping to recapture.
So, I should still have about $1,000 owed in child support but the even split in the 401ks will stand.
I hope that $250 per hour in attorney fees is worth it. Shame a non-legal person is out lawyering your counsel.
