I was officially divorced back in June. Part of our agreement was my ex-wife could live in the house until she finds a suitable place up to 1 year.

Today she had a TRO delivered to me at home and police made me leave the house within 30mins. She claims on Jan 1 that I pushed her down the stairs. I have a camera that shows the bottom of the stairs and also was wearing a body camera (something I’ve done for a few weeks) for situations exactly like this.

On Jan 1 the police were also there 10 minutes after the alleged incident happened because she was blocking me in the driveway and would let me leave. She didn’t mention to the cops that day that I had hit her and I didn’t have any interaction with her since that time, she went to her brothers for the next 2 days. Kids were also home and they know no violence happened, however she was shouting and name calling quite a bit, all on camera.

This is in NJ. I’m speaking with my attorney on Monday, from experience here, do I have to wait the full 10 days for the hearing, or can I go appeal sooner? I have video that covers the time she mentioned the incident happened plus 30 minutes in either direction where nothing except her screaming happened.
