If you have video evidence that proves she's a liar, then she should suffer the maximum penalty under the law as if she had committed DV herself. That would be fair, but that's also why they let women lie without consequence in DV cases.

We talk a lot on here about the dangers of being nice in divorce settlements, in particular giving the ex an unreasonable amount of time to squat in the home before having to sell it or leave. So, unfortunately, this outcome is not a surprise to any of us but it should be seen as yet another warning to never allow an ex wife to continue cohabitating or allowed to squat on the marital home after divorce with no incentives to leave or sell.

That said, if out of necessity an outcome like this is inevitable, make sure there is a provision in the settlement agreement and final order that a claim of DV that is dismissed automatically terminates the living arrangement and the ex must vacate the premises immediately.

This is WHY you don’t allow them to stay in the house. I guarantee she is going for the long haul restraining order, and will not move out.

MY EX claimed to the cops I had r*ped her 6 months ago when I had no camera on me. This was very smart on her as there was no way for me to prove otherwise unless go trial. The system is very corrupt and designed to punish males.

Its so sickening that she can just lie like that and have you removed from your own home for two weeks. People like that should be the ones going to jail.

You cannot appeal a temporary order, especially an ex parte TRO.

You have a hearing date, and the Court will allow you to present your side of events on that date, as well as decide if the TRO should remain in place.

Meanwhile, meet with your attorney and ensure they have all the necessary evidence; follow their advice. And keep to the terms of the order, or you will be arrested.
