I've read many times that it's not a good idea, from a legal perspective, to move out of the family residence until the divorce is finalized. The reason being this could be considered "abandoning" your kids by a judge. But what about in the situation of an uncontested divorce, where there is agreement to 50/50 custody and STBX is going to stay in the house? I need to get a rental house or apartment. Do I really need to wait to move out until we finalize our divorce agreement and it is accepted by the judge and divorce is official? To do this that would mean I'd have to start paying for rent before the divorce is finalized, so that I'd have a place to move into immediately. This is in Texas.
