I guess the issue is, if a legitimate rape victim had their case somehow overturned (like planted evidence, bad prosecutor or a lack of credible witnesses or whatever) would they now be serving time?

Obviously malicious false claims should be harsh on the accuser. But maybe there needs to be a burden of proof of malice or something for the punishment to swap parties.

everyone here who is saying execution, life in prison, or decades behind bars is ridiculous. women who falsely accuse should be charged with filing false claims, and then all other punishments should be given from the civil system. Thats for false claims that are made knowingly, not claims where there isnt enough evidence to convict.

We should call it "role reversal." So lets say the accused victim was sentenced to 10 years, and this person was found innocent. Obviously we let that person go and give what reparations we can. The accusers should now start from the beginning the sentence which was given.

It can be declared as that the accuser is being charge via "role reversal" for the false accusation of said crime, sentenced for the original punishment of said time. The accuser would basically be serving time as a rapist, but in "role reversal" from the false accusation.

This "role reversal" should not be limited to rape cases. A person falsely accused of any crime should be able to put in a "role reversal" case especially if they can prove their point.

In a case where it’s just the accuser failing to uphold the burden of proof, yeah. Jail them right away for that shit. However, if the accused can meet proof required to say that it was not only a false claim, but a malignant one, the accuser should face double the jail time of an actual rape case, that shit is unacceptable.

Not a lawyer, but depending on where you live, some laws are already on the books. Not sure how far libel or slander goes, but in some places perjury is a felony. I'd think that'd carry a bit of weight on one's record.

Jail? I believe the word you’re looking for is prison for such a large offense. I was accused of rape just because she got back with her ex and was just saving her face by pretending she didn’t want it, so her ex would be mad at me instead of her. Luckily nobody believed her except for her ex.
