There's a law in a few states called Alienation of Affection. In these states, the spouse that was cheated on can sue the other party for interfering in the marriage and receive financial compensation.

Just do away with alimony and division of assets, other than jointly owned house or car. 50/50 everything with children. Make parents sign up for parenting class to receive deduction for dependents. Teach high school students about personal responsibility and personality disorders. Mandatory DNA testing.

I have a hunch that the casual infidelity we have now will start to drop off as women will be so damned busy making ends meet. They also won't want to take the chance to be found out cheating come time for the father's name to be put on the birth certificate.

It actually used to be. In fact laws against adultery are still on the books in some states. But after women got the vote, the supreme court nullified them or some stupid shit...because vagina.

It was, and still is technically in some places, but it is either no longer enforced or taken seriously.

I can assure you MEN were the ones excited about widespread liberation from such morality when it was mainstreamed in the 60s and 70s. Turns out that the old morality was pretty favorable to men and now they are MGTOWing over the realization the tables have been quietly overturned.

Do you actually sign anything on paper which explicitly states that you will not be sleeping with anyone other than your spouse? If you do, is it feasible for your spouse to provide concrete evidence in the court that you had sex with someone (photos, video recording etc and not just your car parked below her building). It may be "illegal" for saying's sake and as far as legality of the marriage goes, it's breaking the assumed vow of loyalty which can be a valid grounds for divorce. Among conservative states it can imply a hefty fine or preference for the "cheated on"partner in deciding alimony. That's where the state can intervene and not putting someone in prison because that person slept with someone other than his/her spouse . Courts have a hell lot more to do and should not get a say on matters between two adults in the marriage and two consenting individuals in an affair. We are civilised for a reason and state /society can and should intervene only to a limit.

It would be hard to prove. Not everyone can afford to hire a private investigator to follow their spouse around to catch for cheating. And also imagine women trying to manipulate the system like they manipulate it with their fakerape fantasy fiction.

Thank feminism and the No Fault Divorce. It wasn't illegal back in the day, but if someone didn't live up to their commitments, then the other spouse had some legal standing for divorce. If the husband fucked around or something, the courts would fuck him harder than normal. If the wife fucked around, she got less alimony, and was less likely to get the kids. Introduce No Fault Divorce: Now a spouse can leave, no reason cited, and the way the courts work nowadays, the guy gets divorce-raped. Hence the reason women initiate a vast majority of divorces. No reason to stay, and she gets cash and prizes if she splits.

Because we do NOT LIVE in a theocracy, and it's not a legal crime to cheat.

In some countries it still may be, but in most countries tradcon values and religious doctrine DO NOT constitute law
