Theoretically, yes. Child support is supposed to be paid by the non-custodial parent to the custodial parent. In practice it doesn't seem to be so. My brother has had primary custody of his 3 kids and hasn't been able to get much CS from his EX even though she is supposed to pay according to the courts.

Edit According to this article, in 2010 ~~of the 46% of mothers ordered to pay CS were "deadbeats", versus 38% of fathers~~ fathers failed to pay 38% of CS they owed versus mothers failing to pay 46% of the CS they owed.

I have primary custody of my 3 kids, and mom was ordered to pay the princely sum of $240 per month for CS. She is thousands of dollars in arrears and nobody really gives a crap.

Meanwhile she works sporadically, and drives a brand new toyota suv while I drive a paid off 2006 minivan with over 100k miles on it.

I did the calculations and, even though she has more earning potential than me, had she been awarded custody my monthly CS bill would be in the $1100 range.

the bias here is strong, and i bet you would spend more money in legal fees trying to win what should rightfully be awarded anyway.

In texas they will garnish your wages, take your tax returns, and send you to jail if you dont pay. if you are a man. ive never personally seen a woman or known a woman who pays child support. they always get the kids anyway.

My parents separated when I was 4. Me and my brother went between the two of them until I was 14. My mum payed my dad quite exorbitant amounts of child support until I moved in with her full time and my brother turned 18. In this case, it was because my mother earned quite a lot more than my father (he was a fire-fighter, she was one of the higher-ups in our town's hospital)

I am divorced after three years of marriage. I have sole custody of both of our children. I pay her alimony of half of my salary. Per court order I do not get any child support from the mother. She has a degree and is able to work, and in fact has been working but refused to turn over her financial information. The judge stated that while this was unfair and I have a right to be frustrated, he "could not put a woman out on the street". When I pressed for financial information that the law states she should have to show me the judge said "you need to get along". Mother has not seen the children in over a year, and she lives only 15 minutes away.

He'e entitled to the support and she needs to pay. He needs to go through the proper channels of family law court in the county he is in.

No, it wouldn't. There are many good fathers tossed from their homes, alienated from their children and are deadbroke and the system expects too much and throws them in jail. It's not easy at all.

Why does he need her money ?

Child support does very little to help the children.

Each parent should take care of their own responsibilities.
