If you asked someone who believes that you can never consent while drunk then you'd likely get a response like this: the person who feels like they were raped was raped. If they both feel that then they were both raped. Both could press charges if they wanted to.

Or, they'd argue that only women can be raped. It would depend on the level of crazy.

It's not really a "Feminist" thing, but rather a legal thing. It's not exactly clear when consent under drugs becomes non-consent.

tonight (its 5am down here in South Africa) has been full of very interesting topics. Unfortunately I disagree with some of the statements and points of view being made by some MRAs but I agree with others.

I think that if feminists are going to fight us on the use of the word rape with them insisting that it describes the act of forced penetration then men can get raped but then we can also be "forced to penetrate" (as the CDC likes to term it). Why push the boulder up hill when we can turn it around and send it rolling down the hill.

In the case of this thread regarding rape and alcohol I believe that if either person cannot give consent with a reasonable degree of competent capacity then it is rape. When a girl has had half a bottle of tequilla I would rather let her sleep in my bed while I sleep on the couch than get accused of rape. Hell she might even see my gentlemanly act as a sign of respect and might be interested in more than just a one night stand. If I am too drunk and I don't want sex its very easy for me to reject the advances of any woman since I am 6'4" (1.95m) and I have yet to find a woman that could come close to me in physical strength. But IF I woke up the next morning to find a used condom and a woman next to me I would honestly not call it rape but I stress THIS IS MY PERSONAL CHOICE. If any person, whether male, female, transexual, etc is forced to have sex whether through violence or verbal and mental manipulation then it could be classified as rape. But I have zero tolerance for false rape claims or claims of rape that stem from a person (any gender) regrets having sex with a specific person. I have regretted some sexual encounters and I was 100% sober but they are not rape because both of us were consenting adults and were under the influence of our own sexual drives.

On another thread tonight/today a guy claimed that he feels he was raped by his gf because he woke up with her giving him fellatio. I have had this happen to me with my ex-gf and I was pleasantly surprised. In fact I returned the favour a few nights later. As part of a sexually active couple we looked at this as a means of selfless love-making. But then again this is my experience, my opinion and I am in no way stating that my choices, preferences and opinions are the correct ones and you are an adult and free to make your own decisions and choices but it is your duty as a citizen of whatever country you live in to ensure that your choices do not impact the rights of other people.

I am sure that I will take some flak for this post. These are my opinions and I am in no way saying that you should do what I did or even think the same way as me.

It's not Feminists who think this. Some feminists do, yes. Some MRA's do too. Some people in general do as well. To me, that's not rape, and I'm sick of hearing about people calling that rape, and so are a lot of feminists. However, if some one is incapacitated from alcohol, I consider that rape, or at least the responsibility of the other person to not take advantage of them.

Those are good questions."

Sadly I fear view points like these two ladies hold have not been buried like they should have. These women are openly said that women SHOULD falsely accuse men of rape and that such an accusation would be beneficial to the man. That is disgusting. How about we go around accusing these women of child endangerment and abuse? How about be accuse them of being unfit mothers and drug takers and murderers? Rape is a more socially unacceptable crime and I personally would give a man a fair trial if he is accused of murder but if my daughter tells me he raped her then I will kill him myself.

First, it would help if you cite exactly which feminists said this or believe this. Second, while I don't deny that there are probably feminists that have said something to this effect, this rather simplistic definition of rape isn't one that feminists typically believe in or advocate. You would have a better understanding of the feminist position on alcohol and rape if you asked actual feminists, rather than MRAs. And third, the basic idea is that, given a sufficient amount of alcohol, a person can become too intoxicated to consent (i.e. barely conscious, slurring and stumbling, unable to resist, etc.), and having sex with such a person is rape. It's not just a matter of having been drinking, or even being drunk, but rather about being so drunk that giving consent is impossible.

It's a difficult issue, and the line between rape and non-rape can sometimes be confusing. But ultimately, rape is about the lack of consent, not the degree of intoxication. It's possible for a drunk person to rape a completely sober one, for two drunk people to have consensual sex, or for a sober person to have sex with a drunk or even unconscious person and not be raping them.
