Thing is, if the software does discriminate on those grounds then that will be transparent in the code as opposed to hidden in unofficial policies and procedures and personal politics.

I'd trust an incorruptible and unbiased AI over human judgement.

It is not the software that has been written it is the fact that they are using it which is discriminatory. Even if it is only for guidance they cannot argue that gender is not an influencing factor.

So, if someone did take legal action in my opinion they would win.

To be fair, insurance companies do it all the time, such as when calculating car insurance. Males pay more because they statistically get into more serious accidents.

Not allowed to offer different prices based on gender in Europe for car insurance policies, or annuities. That software is illegal to use in Europe, illegal to discriminate on gender.

You're right, I wouldn't be surprised myself if this were some weird and desperate attempt by feminists to make it so that it's the fault of the 'white patriarchy' and that's why they should be put in charge so that men don't have to suffer under this system anymore that they put in place.

That being said, I'm probably just giving them way too much credit and this woman is probably just saying this as a default response like all feminists tend to.

Blatant discrimination. This is essentially one gender treated as a difference class of citizen by the court system.

The Harm Assessment Risk Tool (HART) uses historical data on offending to classify suspects as low, medium or high risk of offending. The tool uses information such as offending history, the type of crime a suspect has been accused of, their postcode and gender.

So a male is automatically considered a higher risk, no matter what? Yes even if type of crime is considered to, that gender is an independent factor means a man is still having "points" added by default.

But Silkie Carlo, Senior Advocacy Officer for Liberty, warned such systems should be seen as "at best advisory". She pointed to evidence from the US which suggested algorithms in the criminal justice system were more likely to incorrectly judge black defendants as having a higher risk of reoffending than white defendants.

It doesn't say anything about using race, but it does mention using gender. Why is she ignoring that?

When you walk down a dark alley at night, you cower from a strange man going the other direction, but you walk upright if its a woman, and the younger the less you feel threatened by her.

which is bullshit. it's about a risk profile. if males are higher risk at driving, they should have higher car insurance. similarly, if females are higher risk at health problems, they should have higher health insurance.

this is what happens when reality gets in the way of hysteria.

my only problem is that females are not necessarily the less violent gender... simply that:

  • when a women is reported as the perpetrator of a crime, she's much less likely to be arrested
  • when a women is arrested for a crime, she's much less likely to be charged
  • when a woman is charged with a crime, she's much more likely to be offered a plea to a significantly lower offense
  • when a woman is convicted of a crime, she's much less likely to be sentenced to anywhere near the same amount of incarceration time.

so we already know the gendered crime data is shit.

Police should not keep suspects locked up because a computer program has told them they are likely to be offenders, a human rights group has told MPs. Algorithms that predict whether someone is a criminal based on past behaviour, gender and where they live could be "Discriminatory", Liberty said.

Durham Police have already launched a system which uses algorithms to help decide whether to keep a suspect in custody.

Ms Carlo said Liberty had requested data from Durham Police about how common the use of human discretion was in decisions using algorithms, but the request was rejected.
