Never. There are always going to be people trying to game the system for selfish reasons. There's no practical way to implement rules without their being a potential for abuse. Right now society pushes pretty hard in favor of an accuser, which gives the potential for abuse from petty people. Too far in favor of the accused and you give potential for abuse by legitimate criminals.

There's not really a way around it. Whatever you do someone is danger of being screwed. Best we can do is try to mitigate it by revealing truth as often as we're able.

There are problems with that solution. I'm not saying it's wrong on principle or even that it shouldn't be implimited in some way, but there are complications.

First of all, not guilty in our court system is not necessarily the same as innocent. Not that it always actually works like this, but the standard for conviction is beyond a reasonable doubt. Not guilty just means a (theoretically) reasonable person could look at all the evidence and not have any reasonable doubts that the person is guilty. So a verdict of not guilty doesn't automatically mean the person making the accusation was lying.

That leaves us with provable liars. Ocassionally we catch people being idiots and admitting it to someone else who passes the information on (easier now that so much communication is in recoverable text format), but a lot of times someone who made an accusation in a pissed off fit recants it once the reality of what they did sets in. How many do you think would back off and recant, saving the accused months, if not years of court dates, and reverse a chunk of the reputation damage if they knew doing so would send them to prison? Unless you give them an out for admitting it early in the process it's going to have the actual effect of greater harm to the falsley accused.

There's even a problem with that when you add in scum bag lawyers. I can promise you in any situation where a person actually gets raped, can't afford an attorney, and the defendant can, the defending attorney is going to do everything in their power to convince the victim that they're going to prison unless they take the early out option and say the person didn't actually rape them.

I'm not saying the pros can't potentially outweigh the cons depending on how you implement it. In actual fact, I'm pretty convinced that they would, especially in the current social climate. The problem is, acting like this is a simple solution with no down sides is silly. There's very rarely a purely positive solution to a complex problem. Everything has a cost, and in this case it won't always be the guilty who pay.

You have a lot of sense here, for sure. And by my original post, though I disagree, it's not because you're wrong. I just don't want to give up to the idea of this will never change. You're absolutely right that with all the cracks in our justice system, all the manipulation of attorney's, wealth, and power that tips the scales in dishonest people's favor, it's near impossible to hold people accountable. It's a complicated issue for sure.

We have Innocent until proven guilty but it’s stupid in the case of sexual crimes. In those situations it basically becomes guilty until proven innocent. You say “you give potential for abuse by legitimate criminals” though if you can’t prove what happened but the person gets punished anyway what’s the point of a legal system. We should completely believe the accused until evidence is provided to believe the accuser. In every situation when someone is accused their life gets completely fucked. They can lose their job, family etc even if they are found innocent no one wants to deal with them anyway. We have a system in place to protect this but the mentality

believe all women.

Probably because it is, like in most other jurisdictions, hushed-up. Feminist often complain about the conviction rate for sexual offense reports, as the rate of convictions is always in the low single digits as a percent of recorded complaints (2.25% for rape in the U.S. according to RAINN) but that is only half the story, as many, as much as half, of reports are never recorded by police.

Of the ones that are recorded, Britta Rabe says 80% are determined to be false after investigation.

This line of thinking needs to be thrown out, it's repeated every time there's a case of false accusations, but the thing is - real rape victims are not the ones who are hurt by stuff like this.

Real victims need two things - for the police and legal system to treat their accusations seriously and investigate it properly, and support from their close ones. If your friend comes to you and say she or he was raped, obviously you support them (and if you don't, you're an asshole) - but if a stranger on social media or in some artcile say she or he was raped, you thinking to yourself "Ok, that sounds like shit, but I'll wait for some more evidence before I form an opinion", that does NOT hurt them.

That the rest of the world maybe get a tad, tad bit more hesitant to instantly form a social media lynch mob attempting to smear and ruins someones professional and social life on purely on the say so on is NOT something bad - it's a net positive.

No such thing. No one has to prove they aren't lying to avoid punishment. The onus is on prosecution to prove they are lying.

The idea that credibility is enough to convict someone is the bullshit. The reason the majority of men the innocence project helps were convicted of rape is because people pushed to have credibility of the accuser be enough to convict. If you think a man being thrown in jail because one person, with no evidence whatsoever and no other witnesses, said they did something bad is less of a problem than people needing evidence to send someone to jail you're out of your mind.

This is how justice should work. But it doesn‘t any longer in the case of rape/rape accusation. If you are accused of rape, your career is over. You get fired from university, tv series, job not after being found guilty by a judge in a courtroom, but merely for the accusation itself. The only way to avoid this would be total anonymity to the accused. But even this doesn‘t help if due process is ignored, by private tribunals (IX uni) and „believe“-culture.

The criminal justice system works on an innocent unless proven guilty and beyond a reasonable doubt standard, and the onus has always been on the prosecution to prove their case, so yeah that’s absolutely how it should work, and the inclination to believe the victim at face value regardless of the facts and evidence of lack thereof is why people related to victims can’t be jurors in many if not most jurisdictions that still conduct trial by jury.

It’s a lot easier to prove a negative than you make it sound. Alibis can prove you couldn’t have been at location X since you were at location Y at that time. DNA evidence can also provide evidence that it wasn’t your blood on the blade or skin under the victim’s fingernails. At any rate, defendants in criminal trials need not prove anything; as mentioned earlier it’s on the prosecution to prove that the defendant is guilty, and the prosecution must prove it beyond a reasonable doubt.

But I agree that the system can be gamed by liars in that even if a false accusation is shown for what it is—a lie. People are too influenced by first impressions, and are too proud to change their mind about something when they’re proven wrong and instead double down.
