At the very least pay for an hour of legal advice to find out what your options are. You should be able to get a referral from your local Bar association for $50.

heres some further details, i feel nervous writing this in a public forum, but here goes. the deal right now as its been proposed to me, is this...

the ex and her family have already given notice, they will move out of town temporarily to a family members house until they find a permanent place to live. they are telling me that this will take one to three months possibly. so, during that time, i will have full custody of my son and he will remain at his current school, because the temporary place they are moving to isnt big enough for all of them.

so there is a matter of timing here, that may play well to my advantage if i play my cards right...

Here's a great article on move-aways in CA. It walks you through the cases in CA that deal with moving away with the child and then gives you the law.

It looks like lots of what it comes down to is your custodial time. If your actual custodial time doesn't match up with your ordered time, make sure you are documenting the time you spend with your son in a way that's easy to understand.

Go to your lawyer (you need one) with a well-organized set of facts, like the time you spend with your son and his ties to the area.

I'm not going to try to give any legal advice because I don't have direct experience with this situation, but I would contact the courts about barring them from moving until there is a court decision. If you have official 50% custody, she should have to sue for full custody before she can move. If you don't have it down in paper, you need to sue for partial or full custody now

so heres an update to this story. i finally went to court last wednesday, without a lawyer, and i fucking kicked my ex's ASS! i now have about 70% custody and my boy lives with me most of the week, and stays at his current school. there is a pending child custody investigation in to months and a more permanent ruling will follow in february. i couldnt be happier with the outcome so far.

Others here have said to hire a lawyer. The only goal of a lawyer is to get as much of your wealth as possible. It is the only profession where failure is rewarded.

This line here: "i simply cannot afford a lawyer at this time." is absolutely the biggest tell out of your paragraph. If this little boy meant that much to you, going into debt to keep yourself as a part of his life would take not even a second thought. If what you state about having a 50% custody is true (court ordered or otherwise), you should be able to use that to petition the court to halt this (and possibly get the 50% Court ordered).

All I can say is that I do have 50% legal and physical, and if my EW tried to pull that, I would do what I had to...EVERYTHING I HAD TO... in order to keep myself in my children's lives. You can always pay off debts, but you can NEVER get that time back with your kids...

Tell them you want to look after their interests (which you should because anything other than sensible cooperation sets a very bad example for the child.) Then get together and talk about what you all want across the table. The experience of moving may be beneficial to the child, seeing different situations is an enormously beneficial growing up experience, so there is an upside as well as a downside. Try to avoid getting external parasites such as lawyers involved; that is not the behaviour of reasonable adult. Good luck.
