This is a woman who wrecked a guy's career with a false rape allegation and now claims that a man 'raped her' even though by her own admission she was 'too scared' to say no to him. Even if she did not want to have sex with this guy (she was in the hotel room with him to play tiddly winks) how the hell is he supposed to know that if she doesn't tell him?

Not sure if this is the same guy whose life she wrecked with the allegation but I remember that she appeared on TV looking extremely comfortable with him and laughing together sometime after the alleged 'rape'.

We often make this point on our website: A woman's secret or undisclosed intentions, desires or whims are of no legal import in determining whether the act was consensual; nor does her belated, after-the-fact, ex post facto remorse or hissy fits of regret matter. All that matters is whether a reasonable person in the position of the alleged offender, the male, would have construed her words or conduct, based on all the surrounding circumstances, as manifesting assent to intercourse. If a woman gives herself freely to a man, no words need be spoken, enthusiastic or otherwise -- and often words are not spoken. Under no circumstances can that sex be transmogrified into rape.

Here it appears that a woman freely gave herself to a man, despite her purported inner conflict, and the man firmly and unequivocally believed she fully assented to sex based on her admissions. Unless rape has been redefined to convict a man based on a woman's secret thoughts (and, yes, some radical feminists support that), why on earth does the newspaper discuss this incident in the context of "date rape"?
