This… is why the ex and I always do public exchanges. When we were married she used to threaten to call the cops and tell them I was beating on here. The funny part is that literally 100% of the physical abuse was from her (and her sister) against me. Yup. Everything is done in public during daylight hours because she’s a dumb dumb bitch.

In a Texas license to carry class an instructor summed up a justified shooting “you will likely be tried, it’ll cost you everything you have, and you may still go to jail”. Someone yelling at you on your property in Texas doesn’t seem to be a good justification for the use of deadly force. Doesn’t help the dead guy however there may be some surprises in store for the shooter.

Tall guy grabbed short guy’s gun, so I think that’s it. Self defense.

I wish we lived in a world where: 1) you felt threatened 2) you went into the home where it was safer 3) you came back out… now you just moved yourself from safer to less safe 4) no longer self defense

Is it possible that without short getting his gun that tall could have beat short to death? Sure. But probably not. Call me crazy but I would take my getting my ass kicked and us both living over the other guy dying.

I understand not everyone agrees with me on this. I also don’t know the context. Maybe tall had been threatening ex and new short guy for ages and authorities wouldn’t step in. That happens. Also possible ex and new short guy engineering the whole situation to kill him.

I agree, this is going to be self defense. This is in Texas and he came on to another man's property then threatened to take his self defense weapon away from him and kill him with it.

I got to completely disagree with you on this. The short guy is definitely trained and probably prior military. The way he is holding the firearm he is preparing for the guy to try and take it. He follows a clear escalation of force.

He tried talking sense into him:

Shout: He shouted at the man to tell him to get off of his property Show: shows the tall man that he is in fact armed and is willing to escalate force to the death if necessary. Shove: he pushed the man back while holding his rifle Shoot to warn: short guy then shot a single round into the deck near the tall guys feet and created a reactionary gap. Shoot to kill: the tall man continues to yell obscenities and advances toward the short guy after he had previously told him he would take the firearm from him and kill him with it. Two rounds to the chest and room temperature challenge accepted.

This is the exact protocol we use in the military to justify use of force. He hit all 5 elements.

I totally understand people's confusion with guns and use of force. We wish everyone could get along, but unfortunately that is not the option sometimes.

I also think short guy might have been able to take the tall guy hand to hand, but that is also a risk that you need to be willing to take. For people who don't fight often or ever they don't realize that an ass kicking can quickly escalate to death. All it takes is that tall guy to get the upper hand for a split second and it could have easily been the other way around with or without a weapon.

This is a good example of how not to handle child custody issues. That I think we can both agree on.
