Imagine a bunch of men pressing charges against a trans woman for being deceived/having to deal with a real penis.

How would people call them?

It ends with -phobic.

In the 2015 case: "In that case, the court found that the complainant had chosen to have sexual encounters with a man, and therefore that her freedom to choose whether or not to have a sexual encounter with a woman was removed."

My conclusion at the time was that if a man uses his freedom to choose, his choice was deemed to be transphobic but if it's the opposite: the law will side with women because reasons.

Nothing has changed.

I can't even follow your anecdote. I know it's old-fashioned, but if you could add "trans" before trans men or women, I would at least be able to parse who is having sex with whom, and maybe what their assigned gender was.

The only way I can make sense of it is if you accidentally called the original male complainant a "her" at one point.

Let's be honest: this is about the duty trans people have to disclose the fact that they are trans before they have sex with people. It's an issue I struggle with. If I tell a woman that I'm a billionaire so that she'll sleep with me, I think most people would say that's at least rape-y. Some may even flat out call it rape. If somebody who is HIV+ doesn't disclose their HIV status before having sex with others (even protected sex,) that is absolutely morally reprehensible, and very few would argue otherwise, even though chances of transmission would practically be 0.

It simply is the case, unfortunately, that most cis people, myself included, would not be comfortable having sex with a trans person. I acknowledge that it is a discomfort as a result of ignorance, lack of interaction with, and ultimately a deeply held belief about trans people, however a discomfort I have nonetheless. If I unknowingly had sex with a trans person, and I found out afterwards, I would feel something akin to, though ultimately much less damaging than having been raped, I think. That being said, to what degree are others required to probe inside my mind to discern what would personally offend my sense of sexual comfort? And if they fail to identify something that would make me feel uncomfortable, and then act in a way that violates my sense of comfort, should they be charged with assault? I'm super hesitant to even consider the argument from anybody who would say 'yes'.

These are questions I don't have answers to. Here's all I can say for sure regarding my opinions: ideally, one would disclose that they are trans, however I certainly understand the apprehension, for both safety concerns and the fact that it must be really hard to date as a trans person, particularly a trans woman. Generally speaking, trans people don't want to be seen as trans people, they want to be seen as people. They're not identifying as a trans woman, they are identifying as a woman. Would it not be disruptive to their sense of comfort to have to disclose their transness every damn time they have sex with somebody new?

In this particular case, I think charging him with assault is ridiculous, but had it happened to me, I don't know if I would be saying that still. I suppose it's a battle between my feelings, whose validity is supposedly unquestionable, and being a sympathetic and rational human.

Your examples given aren’t exavtly equivalents to what’s happening here though. Lying to someome outright, telling them you’re a billionare, is not the same as not disclosing a fact about oneself. And in your second, not disclosing a factor of the sexual encounter that would undeniably cause concrete physical harm is not the same as not disclosing some aesthetic preference. To prevent assault, it is someone’s responsibility to not lie directly to someone with intention to get them to have sex with you, and it is our responsibility not to hide details that would obviously endanger the other person, but it’s not someone’s responsibility to disclose every fact about themselves that may or may not matter to the other person, even if most people do have a sort of preference.

According to details, they were aware it was likely a prosthetic, since he declared he was a detransitioning trans woman before (instead of a trans man). It seems the "was born female" thing that was off limits to them. After the fact.

Kinda like in the Ghomeshi trial, they were not against the sex, or even the sexual sadism (they were avowedly and enthusiastically masochist, including about the events in question), what they were against is the lack of exclusivity, them being replaced.

While there's some transphobia here, I don't see any misandry. Also, the case seems to be mostly about domestic abuse with the protestic penis being more a detail rather than the central focus.

"Tarjit Singh, who was born as Hannah Walters, presented himself as a man, wore men's clothing and used a man's name. He tricked three innocent women into believing he was male and when questioned, he violently attacked them and intimidated them into continuing relationships.

When the victims began to ask questions, Singh became abusive and manipulative and told one of them there was more to a relationship than sex and that she should learn to talk about her feelings more.

Singh was convicted of three counts of assault by penetration, six counts of assault occasioning actual bodily harm, and one count of making a threat to kill following a trial at Snaresbrook Crown Court.
