Realistically, when the false accusations are rolled out, any prenup usually has a pretty high chance to be thrown out...

It depends in which state you are. You have to ask the lawyer of that state if silver bullet can cancel prenup. Silver bullet is the most powerful way to win divorce cases and child custody. It requires accusation against the husband about child molestation and domestic violence which likely cancels prenup agreement atleast in Australia.

My uncle had a good prenup. He showed it to her, gave her money to see any lawyer she wanted so she would have a legal opinion and understand it before signing.

When it came time to the divorce, his lawyers still advised him to settle because there's always the chance that the judge just throws it out because they feel like it. So even with a well written prenup, paying for a lawyer so she understands the prenup, he still got fucked out of $150k. But, the alternative is she would have been able to straight up claim a ton more if not for it.

my BIL is a family law attorney and writes prenups.

He said it's more an art than anything else. You can't just say "she gets nothing" because the judge will throw that out and it's like you had no agreement at all. So you have to make a guess as to what will satisfy some anonymous judge, some number of years in hte future, and hope you picked the right number.

that's why a lot of wealthy men's prenups are oddly generous, it because they're literally buying an insurance policy to protect themselves from a rogue judge slamming the "steal your money" hammer down on them.

the only bet with odds in your favor is to just not get married. it's that simple. there's literally zero benefits to marriage for most men, and only liabilities. You've been sold a long con scheme that tells you marriage is about love and commitment, but it's not...you have the same love and commitment with or without a marriage.

Marriage is about money. Your money.

If you have wealth and property before marriage, put it in a trust.

The trust is an independent entity, and so the assets are not marital property and cannot be touched in a divorce.

A prenup is useful for when you are entering a marriage with a lot of assets. Maybe you own real estate, a business, a retirement account, shit like that. It is very effective at hedging your "losses" in a divorce settlement. Otherwise, if you are going into a marriage with nothing and then exiting the marriage with assets, a postnup seems to make more sense.

Like many have said depend on the prenup. I’m personally against marriage like many others. But my friend is a lawyer and he says the best thing to do is have your lawyers make a prenup and then send it to her lawyers so that your spouse and her lawyer can review it. That way she can’t call duress or not in the right state of mind as you have your lawyer and her lawyer and potentially any other witnesses that you would like to add to testify against her. However most of the times you would have to pay for her lawyer as she won’t have one and her lawyer would be looking out for her best interest. So if she and her lawyer doesn’t agree to the prenup after reviewing it they will revise it to something they deem more fair and send it back for you and your lawyer to agree upon it. Eventually you would either compromise to the finalized prenup or not get married. Most of the time when it gets thrown own it’s because you made her sign a prenup that was just your lawyer and your spouse. With your spouse not having legal support when signing the contract.
