He will *not** be able to sue*, even if she took the sperm from a disposed off condom. To the contrary, he will be held liable for child support.

Anyone can sue anyone but as for success I'm not sure if there's been a win yet.

I mean boys have to pay CS to their female rapists so maybe start by seeing if there's been any lawsuit over that.

You can try to sue for anything you like. The ridiculous ones without basis normally just get thrown out. Women have tried to sue for child support for men who had taken on a very minor fatherly role by watching her kids occasionally or taking them to appointments.

You charge them with rape / sexual assault. If the condom is a conditon of intercourse if one party removes it without the others consent. Consent is withdrawn it then becomes rape.

This law needs to work both ways...

Oh dear sweet lord. 50-50? Have you ever been on, say, THE INTERNET? A woman can steal a used condom that was disposed (that he prepped by putting horseradish in), use it on herself to try to get pregnant, and sue him for assault.

Alternate story ive seen: woman does the same thing (no horseradish) , gets pregnant. Man tries to argue the case in court that he did due diligence to prevent pregnancy and is therefore not responsible for the child. Still owes child support due to the assertion that the sperm had left his body and was now a "gift to her".

In Quebec, Canada, a judge ruled that a man who intentionally removed his condom during sex (called ghosting I'm called) was guilty of rape as there was a obvious and agreed upon requirement for sex...the use of a condom. When removing that condom, there was no consent. That's what I remember anyways...

So....with that being said can a man sue a woman for rape if she lies about being on birth control of any kind (pill, IUD, etc) and if she forgets to take said pill can she be sued? I bet you he can't...

If he even decides to sue her I think there will be no chances of him wining.
