I was married for 13 year and have about $1M in my only 401K account. I started working immediately after graduating college and starting my contributions as of my first paycheck. I worked without any breaks and contributed out of every single paycheck for 8 years prior to the marriage.

Everything I read online states that I should get some credit for the non-marital part of the 401K. However, at a pre trial hearing the 401K came up. I was offering her half the coverture value of the current balance based on years of marriage (13) over the total years of contributions (21). The judge said that because there was no prenup, the full value should be divided 50/50. My lawyer says that because this is a midterm marriage it’s 50/50.

Am I missing something here? This just doesn’t seem right and contradicts everything I’ve seen online. Does anyone have any experience with this or any advice?
