Divorce is not the time to DIY. You're learning the hard way that your extralegal agreement with her about the property will not be enforced by the court.

It's all "marital funds" according to the court. One side can make all of the money, the other side loses it all gambling and the courts won't care.

At this point in time, it is lawyer time -- and be prepared for her to go after every last dime. 50% of all assets and then alimony as well.

This happens a lot. The “why” is kind of important if you want to try to revive some of all of the agreement. Sometimes the stbx isn’t ready to divorce, sometimes they start talking to friends who push them to go for more … try to raise this in a non-confrontational way before you need to go into conflict mode. I’d guess she has a short term cash need. That’s a carrot you can dangle for her to get it done and dusted quickly.

Hopefully the agreement isn’t so lopsided that the judge starts asking questions. If it is - well, you never really had a deal in the first place then.

Do not matter what you did during the marriage. How you supported her what your sacrficed if she was on title for or contributed. She could have smoked drugs all day , not work. Her contribution or lack of means nothing .

You need to clarify; these two statements conflict. Was the “settlement agreement” merely transmitted between you two? Or, was the “settlement agreement” signed by both of you, notarized, and properly filed as a resolution of your divorce petition? In fact, have either of you even filed for divorce? Do you have an active case?

And this is why you need a lawyer. Settlement agreements can be enforced — but this shit needs to be done properly, with everything properly itemized, executed, notarized, and properly filed in a case where both parties have been properly served and are under the Court’s jurisdiction. If you don’t have all of that, you don’t have jack shit and your “settlement agreement” is glorified toilet paper.

You could have been in a great position, and perhaps you are, depending on how exactly this “settlement agreement“ was reached, executed, recorded, and whether and where it was filed. Stop fucking around. Get a lawyer.
