Dude - why is permission for domestic travel in your decree? It should just be parent A has to inform parent B if they travel out of State.

You guys can’t take your child to Disneyland or even drive one State over without permission from the other parent? Ridiculous.

And summer camp? If you don’t want to do it and your kid doesn’t - forget it. Now you have a situation where the parent who isn’t physically with the child gets to dictate what activities the child and the parent who is actually with them gets to do while they are away? Insanity.

Yes - you need to go back to your lawyer and fix this because this is going to be an issue for 18yrs otherwise.

This is the very reason why I did not put on travel restrictions in the USA. We are not allowed to bring them out of the country but can go anywhere in the USA. I'm amazed at some of the details put in these custody agreements.

I would take her to court and get that language removed. You would have to get permission to go to the grand canyon? F that. Just a notice is all that is needed.

Camps are extracurriculars. Note the "extra" prefix. They don't trump time with a parent, and no parent is required to take their kid to extracurriculars during their parenting time. Now as a kid gets older and self-advocates for extracurriculars, that's a different situation.

As far as visiting family out of state when it's your parenting time, ask for forgiveness not permission.

Yes. You go back to court, explain how this provision is being abused. I think you have to get this removed, else you’ll be right back here an endless number of times.

I had a similar problem with my ex. She would call the police for child abduction every time she felt the kids were leaving the state (?). No proof, just felt the kids left the state. We had to get the court to include in our decree to inform the other parent when traveling out of state.

As for your situation...I would just travel out of state with your child.

If the ex calls the police, then you need to be more than willing to travel back to your state to exchange the child with ONLY your ex. Your ex is away for the summer and won't do that. The police will say it's a domestic issue and advise to take it back to court.

Your ex would have to argue to the court why time in state, away from family is best for the child. You would have to argue why you're not following the court's order because it was no longer in the best interests of the child.

The court would likely just add a line in the order to inform the other parent when traveling out of state.

Mine insisted on it and after she got an order requiring written permission….she has now stopped asking for it. I ran up her bill $10,000 negotiating two trips. What a pain.
