There are things in this and other articles that don’t add up to me.

"The jury's verdict shows they were sure you had assaulted Harvey, causing the very serious head injuries that led to his death."

So, they are saying the verdict and evidence shows she committed murder, yet she’s getting off with a manslaughter conviction. Why?

None of the articles I’ve read explain this disparity. Was the jury empathetic? Did the judge decide to give a lenient sentence? Did the prosecution focus on the manslaughter charge because it was a slam dunk? The article leaves out more than it explains.

The article makes it seem as though she got charged with both crimes but acquitted for murder. I’m not sure how they decided that it wasn’t murder either. She’ll be out in 10 years.

You are either charged with manslaughter or homicide/murder. Manslaughter means you accidentally killed the person so if you cause a car accident or if you get into a heated argument and shove them but they trip and crack open their head etc. It's a matter of intention in simple terms. So this case it could have meant their was some form of struggle and she accidentally shoved him and he hit his head and died. It would still be an "assault" and the result of death. Obviously no one can actually 100% know what the Intention was sadly and it's still a tragic horrible thing

She was charged with murder and GBH on a separate occasion she was convicted of manslaughter on the first charge and GBH on the second. The mens rea for murder and GBH are the same (that is to say you don't have to intend death for murder).

So its a bit odd to say the first time she intended and achieved wounding and the time she killed him she intended battery and didn't know her own strength.

That said; I don't really think the lack of murder conviction affected her time behind bars as knowing what I know about English judges I would predict a 10 year tarriff.

Straying from the law as written: David Bagby list GBH alongside murder and manslaughter as crimes for which only acquittal should result in your release. Arguing all of these people are to dangerous to allow in to normally society.

Ah ok I didn't honestly read it because I didn't want to read about yet another sad case with kids and was just going on the info I had seen in comments at the time. I do agree though in a manslaughter case like this it seriously makes you question what this person would do if presented the opportunity. It's clearly not 100% an accident like maybe you were driving and hit a patch of really bad ice killing someone. It was due to your own poor emotion regulation that someone ended up dead. I hope the kid didn't suffer any prior abuse or anything like that.

Borrington was also convicted of inflicting grievous bodily harm for previously breaking Harvey's arm, and assault occasioning actual bodily harm for an incident in which she squeezed his cheeks.

She was given a two-year prison sentence and a six-month term for these offences, to be served concurrently with her manslaughter sentence.

He also said she would serve two-thirds of the 15-year sentence in prison before being released on licence.

Concurrent sentences are so fucking stupid. Plus she’ll be out in 10 years. Ridiculous.

i wasn't being serious lol. i'm sticking with life without parole. she took a child's life and you're not supposed to mess with the children. that's a plant that isn't even done growing and he was a one year old so he was a little seedling and she disturbed it
