An estimated 8% or 20 million Americans have been falsely accused of abuse. They can't keep them all from being employed.

I'm not an attorney but what you need to know is what you are required to tell a prospective employer.

If you still have your clearance in tact there's no reason to worry.

The military should have already had your fingerprints and DNA on file from when you signed up.

I imagine that if it does jam you up, you have a case for a lawsuit against the military, and your false accuser.

first go to your local courthouse, from there you can ask for a background check, just provide an ID, IF by chance it comes up, call CID or contact your military criminal court. and speak to them, you might need a judge to get it removed.

Chances are you're okay. If you're that concerned, talk to a lawyer who specifies in the UCMJ and military investigations.

If there was a no PC determination, your fingerprints/DNA should not have been submitted to the FBI or USACIL.

It’s absolutely INSANE how many falsely accused victims get thrown out as being “real” . It’s so fucked up . This might be a hot take but women I feel like are mostly the ones doing this shit, for some sort of revenge etc. keep in mind I’m not saying that they all do it for the specific reason but I’ve seen it myself . ALSO keep in mind I’m not discrediting ACTUAL female rape or sexual assault victims . I see that women are protected in the justice system extremely . It’s something idk how and why the law doesn’t hold these people accountable.

The question is would a potential employer be able to know that we’re accused of sexual assault? If not you should be ok.

Otherwise think about it, who would you rather hire, someone who was never accused of sexual assault or the person that was? Assuming both candidates are qualified for the job why take on a potential liability?

For most types of positions, probably makes no difference.

Rough/approximate rule-of-thumb, if it's not a government or clearance position or dealing with or caring for children, for the most part, only actual convictions will matter.

I'd also guestimate if it was investigated and you were cleared, probably mostly a non-issue ... though for goverment and/or clearance positions, I'm guestimating they may look that over ... and/or even probe more deeply into it.

So, in a nutshell, I'd say if you're innocent, don't sweat it - the truth shall (at least generally and eventually) set you free.

And ... folks that have done more government and/or clearance work may be able to provide more information (I've got a tiny bit, but relatively negligible, experience in those realms). There are also some subreddits that may be better for asking and getting answers on those matters in general.

Sorry to hear this happened to you. If you are concerned about wasting time on a degree, and have some military experience in IT (just a guess since you said you wanted to pursue that), perhaps a good “test the waters” step would be to try and get a low-level IT job (help desk).

Another option could be to work at a high-trust job like a firearm shop or range and see if they have any issue in your background check.

Then once you know your situation you’ll be better equipped to pursue the degree or not!

I’ve seen it happen I was dating a guy, and it was going well. All of a sudden a woman he rejected, got quite angry and reported him for sexual assault. The university believed it he was kicked out. I remember bawling my eyes out on the train platform as he was leaving.
