I would like to know if there is ANYONE on this subreddit who has taken their accuser to court over false allegations? Regardless of the outcome, I would like to hear what happened. I don't care to hear about celebrity or high-profile cases either.
I am dealing with an NPD spouse whom I've filed for divorce from and who's triggered 5 CPS reports against me alleging sexual abuse of my pre-k daughter, all found to be unsupported. This demon had a rape kit performed on my pre-k daughter, the police refused to release the official results to me but needless to say I would have already been behind bars if it was positive, everyone understands that including the GAL and judge assigned to our divorce case. Only up to 4% of divorce cases include sexual abuse allegations, how lucky am I to be part of that figure?
She also retaliated against me when she was arrested for DV against me, by claiming I assaulted her when she was pregnant, which forced me to drop my CREDIBLE criminal case against her.
As an NPD, the fact that I FILED and not her cannot be understated, her ego is mortally wounded, After she was arrested, she sent a Christmas card to all my family and friends stating that she asked me to file because she no longer loved me.
She has gone through 4 lawyers and has outspent me 2:1 on legal bills and I am the one living in the marital home. I have been prepared and proactive in my divorce case and am poised to gain 50/50 custody (I currently have 40/60). It is sad this is considered a victory under my circumstances. That said, I am troubled knowing that these court documents even exist and that my ex-spouse will and has spread these false allegations to her friends and daycare parents. She has already told me she would tell our daughter about "what happened" and if I do have another woman in my life, will likely tell her too. My daughter is young right now, when she gets older, she will think I was too young, what did I know, maybe there is a possibility dad did something?
I made a motion to seal our court case, to which my spouse agreed (curious), but the judge only put a 2 year time limit, after which I have to file another motion to extend it! The judge and lawyer told me that no average citizen can attain these documents, thats not true.
I spoke to my criminal attorney and he told me that I could go after her for tort in a civil case, but that the criteria to prosecute a false allegation is high since you must have proof that she intentionally lied about her allegations AND that there is clear monetary loss associated with that. Additionally, the cost to pay the lawyer may not make it worth it in the mind, but I do not mind going to pro-se in order to see her face justice.
