ROFR usually has a timeframe attached to it. Such as if she'll be unable to exercise her time for 24, 48, or 72hrs or more.

Right of first refusal should be written in painfully explicit language in the separation agreement. If someone you don't want in your house is in your house, you should be petitioning for a restraining order to keep her away from your house. You don't need a reason. She's persona non grata.

Yeah you only have a case of right of first refusal if it is more than like 8-12 hours at a time.

How did she kick you out if you don't mind me asking? I think its the most entitled bs women do when they actually feel like they have a right to kick a man out of their own home that they didn't contribute a dime into the mortgage.

It sounds like you don’t even have a temporary agreement in place so no.

Now once you do if she is just having her Mom babysit for short periods time (say after school for a few hours) I would say no. If Grandma is doing overnights/ or if the kids are getting dropped off there for days at a time maybe.

But assuming your kids love their Grandma and she’s a kind and loving care taker - I wouldn’t push this too much. WHEN you get your 50/50 squared away just worry about your time. If the kids are well cared for with Grandma on her time let that go.
