Hi guys, 4 years marriage with a 2 year old. Haven’t talked about separation yet. Still under the same roof. My stbx and I have separate accounts. I know she has loaned funds 150k to her sibling. Not sure whether everything was received back. She can gift more to remove them from joint marital assets. In order to prevent her taking some advantage in negotiations in mediation, should I do the same?

I have heard conflicting opinion 1. First is that, everything can be found out during discovery and eventually if it goes to trail, it becomes obvious to a judge. Does judge actually take that into account while dividing assets?

  1. Second is that any gifted assets before legal separation is totally valid as its your own money and you have no restriction to do whatever before the separation so gifting is legit. Is this is this the case I should rather do this as well.
