Married my wife in 2020 and have a 2 year old. Things have soured over the years and we have no trust in each other. We barely talk except when absolutely necessary. Still in the same household and haven’t talked about separation. IMO she would like it to continue like this as she has financial security. She may even create issues like false abuse or DV cases to prevent me shared 50/50 parenting. I want out as I think I’m better off alone than a one sided relationship. Which scenario is better?

  1. Talk about separation and give her a few days if she wants to negotiate things amicably? Main issues are 50/50 parenting, no alimony, CS as per incomes ( I will pay 700-800 pm). Meanwhile retain a lawyer and if she does not respond or cooperate in a few days file immediately.

  2. Immediately file and then talk saying I had no choice. This because filing first seems to have strategic advantages. To my understanding, it will make false allegations harder and shared parenting more likely.
