I live in Wisconsin and did this. It held up. All I owed her was 30% of the equity in my house, nothing else. Saved my a few hundred thousand.

I did get her to draft the postnuptial agreement though, which I think went a long way. She not only drafted it, but also scheduled the notary. Being as this was now her contract, I think that helped a lot. Just put some pressure on her to draft up the contract since she is the cheater.

A strategic legal separation is vastly better than a post-nup. Remember the rule that you can only fight fire with fire. I don't know if legal separation is available in ND, but you should file for some sort of financial separation (give yourself a favorable asset split and no alimony), get her signature and get it stamped by the court. When you eventually divorce, this is far better then either a pre or post nup

Just divorce and then reconcile if you want to keep her in your life. Best way to protect yourself. Divorce is forever.

Well, my experience with postnuptial agreement (marriage agreement) is that not much consideration is given to them by courts. If you run into the wrong judge, he/she will railroad you anytime they feel like it. Agreements, contracts and laws are for some courts optional and it is not much you can do about it. This happened in France but I doubt that it is any better on the other side of the Atlantic. Once married it is a lottery when it comes to courts and as with lotteries most people lose, especially if you are a man.

They hold up better than prenups, so long as they are legal... Just be aware you can't address child support or custody in them... but you could cap an limit spousal support as if you had split today... or address other issues. ..

Most lawyers will do a free consultation about this, just make a few calls and figure it out.
